ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 7 June 2019 DOCKET NUMBER: AR20170008649 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show all authorized awards, decorations, time in primary specialty, and military education. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record). FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 does not show his ribbons, overseas duty, marksmanship badges, and his time as a 13B10 (cannon crewmember). He believes the record is erroneous because it does not accurately reflect his military records. 3. A review of the applicant’s service record shows: a. He enlisted in the Regular Army on 17 September 1998. His DA Form 2-1 (Personnel Qualification Record) shows he completed one station unit training, 15 weeks of training in military occupational specialty (MOS) 13B, earning the MOS around 14 January 1999. b. He served in Korea from 26 January 1999 to 25 January 2000. c. His DA Form 2-1 and Enlisted Record Brief (ERB) reflect the following awards or badges: * Army Service Ribbon * National Defense Service Ribbon * Sharpshooter Marksmanship Qualification Badge with Rifle Bar * Sharpshooter Marksmanship Qualification Badge with Hand Grenade d. On 20 November 2000, he was honorably discharged from active duty. His DD Form 214 shows he completed 2 years, 2 months, and 4 days of active service. It also shows in: * Block 12 (Primary Specialty) 13B10, Cannon Crewmember, 0 years 0 months * Block 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized), None * Block 14 (Military Education), None 4. By regulation (AR 635-5), the DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty. It states for a. Block 11 shows the primary specialty. Form the ERB, enter the titles of all MOS served for at least 1 year and include for each MOS the number of years and months served. For time determination, 16 days or more count as a month. Do not count basic training and advanced individual training. . b. Block 13, list awards and decorations for all periods of service in the priority sequence; each entry will be verified by the soldier’s records. Do not use abbreviations. c. Block 14, from the ERB, list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. This information is to assist the soldier in job placement and counseling; therefore, do not list training courses for combat skills. 5. By regulation (AR 600-8-22), a. The Overseas Service Ribbon, is awarded to all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status for successful completion of overseas tours. b. The National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 and 27 July 1954, 1 January 1961 and 14 August 1974, 2 August 1990 and a date to be determined. c. The Army Service Ribbon is awarded to all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status upon successful completion of initial entry training. d. The Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined that partial relief was warranted. Based upon the documentary evidence presented by the applicant and found within the military service record, the Board determined that all awards outlined below in the administrative notes should be added to the applicant’s DD Form 214, as well as the time served within his military occupational specialty. However, the Board also concluded that there was insufficient evidence to show that any additional military training was completed by the applicant which was not already noted on his DD Form 214. Therefore, the Board recommended denying that portion of the applicant’s request. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by: * deleting (in Item 11) 13B10, Cannon Crewmember, 0 years 0 months; add 13B10 Cannon Crewmember 1 Year 10 Months * adding (in Item 13) the following: * Army Service Ribbon * Overseas Service Ribbon * National Defense Service Ribbon * Korea Defense Service Medal * Sharpshooter Marksmanship Qualification Badge with Rifle Bar * Sharpshooter Marksmanship Qualification Badge with Hand Grenade 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to adding additional military training to the applicant’s DD Form 214. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 635-5 (Separation Documents), currently in effect, provides for the preparation and distribution of the DD Form 214 (Certificate of Release or Discharge from Active Duty). The DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. a. Block 11 shows the primary specialty. Form the ERB, enter the titles of all MOS served for at least 1 year and include for each MOS the number of years and months served. For time determination, 16 days or more count as a month. Do not count basic training and advanced individual training. . b.
