ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 11 September 2019 DOCKET NUMBER: AR20170008698 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to add Army Achievement Medal (AAM). The applicant states an Army Achievement Medal needs to be added to his records. The citation with an award was presented on 23 September 2016 for being Distinguished Honor Graduate for class 70-16, Bravo Battery, 1st, 31st Field Artillery. 2. The applicant provides DA Form 638 (page 1 only) and DD Form 214. 3. A review of the applicants’ service record shows: a. He enlisted in the Army National Guard on 8 October 2015. He entered active duty for training (ADT) on 11 July 2016. b. He was honorably released from active duty training on 8 February 2017. His DD Form 214 shows he completed 6 months and 28 days of net active service this period. It also shows he was awarded or authorized: National Defense Service Medal and Army Service Ribbon 4. The applicant's former unit conducted a thorough search for award of the Army Achievement Medal pertaining to the applicant. However, no hard copies of the award recommendation or approval were found, and no permanent orders were recorded in their historical logs. 5. By regulation (AR 600--8-22), award of the Army Achievement Medal requires a formal recommendation, approval through the chain of command, and announcement in orders. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was not warranted. The applicant’s contentions were carefully considered. The evidence provided did not include page 2 of the DA Form 638, which would show the award was approved, and a permanent order number. In addition, the applicant did not provide an AAM Certificate depicting its approval with a permanent order number. The Board agreed there is insufficient evidence to grant relief. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. AR 600-8-22 (Military Awards, in effect at the time, governed the eligibility and award authority of all awards and decorations issued to members of the U.S. Army.
