APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 does not reflect that he served in the Gulf War from1990 to 1991. He would like for this information corrected and receive a copy of an updated DD Form 214. 3. A review of the applicant’s service record shows the following: a. He enlisted in the Regular Army (RA) on 7 September 1988. b. DA Form 2A (Personnel Qualification Record) shows in Section IV- Service Data, Item 17 (CURR/LAST FST/CODE) Korea. Last combat date tour/date reflects none. c. He was released from Active Duty on 11 June 1992. His DD Form 214 shows an honorable character of service. He completed 3 years, 9 months, and 5 days of net active service this period. Block 12f (Foreign Service) shows 1 years Foreign Service. Block 18 (Remarks) does not reflect Foreign Service duty assignment overseas during the Persian Gulf War. 4. Army Regulation (AR) 635-5 (Separation Documents) DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty).will be issued to provide missing information or to correct any information. Block 18 (Remarks) will be utilized to address incomplete item and state “DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty) will be issued to provide missing information.” DD Form 215 will be issued when the missing information becomes available. Block 12f enter the total amount of Foreign Service completed during the period covered in block 12c. Obtain the foreign service listed in Sec 1, DA Form 4037 (ORB) for officers or Item 5, DA Form 2-1 for enlisted soldiers to compute this entry. If necessary, verify the Foreign Service in the MPRJ. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was not warranted. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board found no evidence that the applicant had any foreign service in the Gulf War. The Board wished to inform the applicant that if he has such documentation, he can reapply with the board for reconsideration.
