The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he attended and graduated from airborne training at Fort Benning, GA right after he graduated from basic training. He noticed the discrepancies when he looked at his DD Form 214 to use it for his application to be a naturalized U.S. citizen. 3. A review of the applicant’s service record shows: a. He enlisted in the Regular Army on 7 July 1993. His DA Form 3286-59 (Statement of Enlistment, U.S. Army Enlistment Program, U.S. Army Delayed Enlistment Program) and DA Form 3286-64 (Statement of Enlistment, U.S. Army Station/Unit/Area Enlistment Program) shows on page one of each form that he enlisted for career management field 11 (Infantry). DA Form 3286-64 shows “If Airborne is required enter “Airborne Training, if not enter NA). Airborne Training is hand written on page one. b. On 7 July 1993, he was assigned to the 30th Adjutant Battalion (Reception), Fort Benning, GA. He completed basic combat and advanced individual training and was awarded primary MOS 11B (Infantryman) on or about December 1993. c. His DA Form 2-1 (Personnel Qualification Record Part II), prepared date 9 July 1993, shows in: (1) Block 17 (Civilian Education and Military Schools), school as U.S. Army Intelligence Center, Fort Benning, GA, and course as infantry. (2) Block 35 (Record of Assignments), effective date 6 December 1993, MOS 11B1O, principal duty rifleman, and assigned to Headquarters and Headquarters Company (HHC), 3rd Battalion, 21st Infantry, Schofield Barracks, HI. d. His DA Form 2A (Personnel Qualification Record Part I), prepared date 26 February 1996 shows his primary MOS as 11B1O. e. On 1 March 1996, he was honorably released from active duty and transferred to the U.S. Army Reserves (USAR) Control Group (Annual Training (AT)). He completed 2 years, 7 months, and 25 days of net active service this period. His DD Form 214 shows in: • block 11 (Primary Specialty), 11B1O 00 Infantryman • block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized): • Army Lapel Button • Joint Service Achievement Medal • National Defense Service Medal • Humanitarian Service Medal • Army Service Ribbon • Expert Marksmanship Qualification Badge with grenade bar • Sharpshooter Marksmanship Qualification Badge with rifle bar • Sharpshooter Marksmanship Qualification Badge with machinegun bar f. On 3 June 1996, he was assigned to 416th Engineer CO HHC as an 11B. g. On 11 February 1997, he was assigned to 98th Quartermaster CO in duty MOS 77F1O (Petroleum Supply Specialist). h. On 22 February 1998, he was issued a DA Form 1059 (Service School Academic Evaluation Report) for failing to achieve course standards due to failing to meet attendance standards at the 77F1O phase one course. 5. On 23 May 2001, he was honorably released from the USAR Control Group (AT). 6. By regulation, 635-5 (Personnel Separations - Separation Documents), the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. The instructions for completing the DD Form 214 states for: • block 11, enter the MOS codes, titles, years, and months for warrant officers and enlisted personnel • block 13, enter all awards and decorations 7. By regulation, 600-8-22 (Military Awards) states award of the basic Parachutist Badge requires that an individual must have satisfactorily completed the prescribed proficiency tests while assigned or attached to an airborne unit or the Airborne Department of the Infantry School or have participated in at least one combat parachute jump. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. The applicant’s contentions were carefully considered. Evidence of record shows he enlisted for and was trained as an 11B. His record is absent evidence showing he attended 91B MOS training or that he was awarded 91B as a MOS. In addition, the Board agreed his record is absent evidence showing he attended and completed the Airborne Course. Title 10, USC, section 1552(b), provides that applications for correction of militaryrecords must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
