The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, his social security number (SSN) is incorrect on his DD Form 214. He states his DD Form 214 currently shows his SSN as “xx#-xx-xxxx”, but should read “xx#-xx-xxxx” as reflected on his SSN card. 3. The applicant provides a copy of his SSN card that shows his SSN as “xx#-xx-xxxx.” 4. A review of the applicant’s service record shows: a. He inducted into the Regular Army (RA) on 11 June 1965. b. DA Form 20 (Enlisted Qualification Record), Item 38 (Record of Assignment) shows he served in the military occupational specialty (MOS) 31M (Radio Relay and Carrier Attendant), assigned to Company B, 127th Signal Battalion, U.S. Army Pacific (USARPAC) from on or about 14 November 1965 to 16 March 1967. c. DA Form 2349 (Military Pay Voucher), for pay period 1-28 February 1967, includes the applicant’s service number while in the RA in Item 4 (SERVICE NUMBER) as “USXXXXXXX#” and shows the applicant’s SSN listed at the time in Item 5 (SOC. SEC. NO.) as “xx#-xx-xxxx.” d. On 18 March 1967, the applicant was released honorably from active service and transferred to the United States Army Reserve (USAR) Control Group (Annual Training). He served 1 year, 9 months, and 15 days of active service. Item 3 (Social Security Number) of his DD Form 214 shows his SSN as “xx9-xx-xxxx.” e. Item C (Make Necessary Correction or Change) of USAAC Form 170 (Army Reserve Personnel Data Review), dated 5 June 1967, shows the applicant’s SSN was corrected to read “xx#-xx-xxxx” on his USAR service documents. f. AGUZ-PAD-S Letter Orders Number 05-1087900, dated 26 May 1971, issued by the Office of the Adjutant General, U.S. Army Administration Center, Saint Louis, MO, shows the applicant’s SSN reads “xx#-xx-xxxx.” 5. By regulation (Army Regulation (AR) 635-5 (Separation Documents)), DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty).will be issued to provide missing information or to correct any information. Item 3 (SSN) transcribe Social Security account number from DA Form 2139 (Military Pay Voucher). “DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty) will be issued to provide missing information.” DD Form 215 will be issued when the missing information becomes available. 6. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was warranted. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board concluded that an administrative error occurred when publishing the applicant’s DD Form 214 by transposing the SSN numbers of the applicant. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 changing the SSN reflected in Item 3 to reflect the SSN reflected on the provided SSN card by the applicant. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
