The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states box 11 on his DD Form 214 shows an incorrect service time as 68W10. It shows only 3 years and 2 months as a 68W10. He was awarded the 68W10 MOS on 1 June 2012. He was released from active duty on 6 November 2015. The correct service time as a 68W10 should be 3 years and 6 months. 3. The applicant provides: * Two Certificate of Completion – Health Care Specialist Course * Orders 135-203 dated 14 May 2012 – awarded primary MOS 68W10 (effective date,1 June 2012) 4. A review of the applicant’s service record shows: a. He enlisted in the Regular Army (RA) on 7 November 2011. b. The applicant’s service record shows he was officially awarded the 68W10 MOS on 1 June 2012. His ERB (Enlisted Record Brief) shows he only held the 68W10 MOS during his enlistment. c. On 6 November 2015, his DD Form 214 shows that he was honorably released from active duty. He completed 4 year of net service for this period. His DD Form 214 shows the following information in block 11 (Primary Specialty) 68W10 Health Care Specialist: 3 years 2 months. 5. AR 635-8 (Separation Documents) prescribes the separation documents prepared for Soldiers upon their retirement. It establishes standardized policy for the preparation of the DD form 214, which is a synopsis of the Soldier’s most recent period of continuous active duty. In block 11 (Primary Specialty) enter the titles of all MOSs or areas of concentration (AOCs) awarded and held for at least 1 year during the current period of service and include for each MOS/AOC the number of years and months held. For time determinations, 16 or more days counts as a month. Do not count time in training (basic training, advanced individual training, Basic Officer’s Leader Course, or MOS-producing school). Primary specialty MOS or AOC is awarded by Service school completion or by publication of orders awarding the MOS or AOC. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was warranted. The applicant’s contentions were carefully considered. His DD Form 214 shows he served in MOS 68W for 3 years and 2 months. He contends his time in MOS 68W should show 3 years and 6 months. The Board agreed evidence of record shows the time served in the MOS (1 June 2012 through 6 November 2015) is 3 years, 5 months, and 5 days, and that the separation document should be corrected to reflect 3 years and 5 months. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending block 11 of his DD Form 214 for the period ending 6 November 2015 by showing “68W10 HEALTH CARE SPECIALIST – 3 YRS 5 MOS//NOTHING FOLLOWS.” 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to showing he served in MOS 68W 3 years and 6 months.
