Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20140005371 on 22 October 2014. 2. The applicant states he would like to reiterate that being attached to the 4th Battalion, 47th Infantry, 9th Infantry Division (4/47 IN, 9th ID), he should have been awarded the CIB. The only evidence he has is his DA Form 1341 and General Orders Number 3335. 3. The applicant provided: a. His DA Form 1341 to show he was assigned to Company C (Co C) 4/47 IN, 9th ID. b. His General Orders Number 3335 to show he was awarded the Air Medal while assigned to Co B, 4/47 IN, 9th ID in the Republic of Vietnam for meritorious achievement while participating in aerial flight. 4. A review of the applicant’s service record shows: a. On 15 November 1966, the applicant was inducted in the Army of the United States. He was trained in and held military occupational specialty 13E (Field Artillery Operations and Intelligence Specialist). b. His DA Form 20 item 38 (Record of Assignments) shows he was assigned to A Battery, 3rd Battalion, 34th Artillery, 9th ID in the Republic of Vietnam and his duty military occupational specialty (MOS) was Field Artillery (13A), Cannon Fire Direction Specialist. c. He was honorably released from active duty on 14 November 1968. His DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) item 23a (Specialty Number and Title) show 13E40 Field Artillery Operations and Intelligence Specialist. The CIB is not listed as an authorized award. d. On 27 October 2014, the Board considered the applicant’s request for the award of the CIB and denied it. The Board shows during the Vietnam Conflict, only enlisted Soldiers who held and served in an infantry unit in MOS Infantryman-11B, Indirect Fire Infantryman-11C, Armor Reconnaissance Specialist-11D, Infantry Operations and Intelligence Specialist-11F, Infantry Senior Sergeant 11G, or Infantry Direct Fire Crewman-11H were eligible for the CIB. The applicant was assigned duty MOSs 13A and 13E while in Vietnam. The unit of assignment alone does not qualify a Soldier for award of the CIB. The Soldier must also possess the required MOS. 5. By regulation 600-8-22 states the CIB is awarded to infantry officers and to enlisted and warrant officer persons who have an infantry MOS. They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size. Additionally, Appendix V of U.S. Army Vietnam Regulation 672-1 states that during the Vietnam era the Combat Infantryman Badge was awarded only to enlisted individuals who held and served in MOS 11B, 11C, 11D, 11F, 11G, or 11H. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. The applicant’s contentions were carefully considered. Evidence of record shows his primary MOS was in the 13 series within Field Artillery. Regulatory guidance provides only members within Infantry and Special Forces career fields are authorized the CIB. The Board agreed there is insufficient evidence to amend the previous Board’s decision. ? REFERENCES: Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. A Soldier must meet the following three requirements for award of the Combat Infantryman Badge: a. Be an infantryman satisfactorily performing infantry duties; assigned to an infantry unit during such time as the unit is engaged in active ground combat. b. Actively participate in such ground combat. Campaign or battle credit alone is not sufficient for award of the Combat Infantryman Badge. d. The Vietnam Conflict, subsequent to 1 March 1961, any officer, warrant officer, or enlisted Soldier whose branch was other than Infantry will be eligible for award of the Combat Infantryman Badge provided all the below listed requirements have been met: e. Assigned as advisor to an Infantry unit, Ranger unit, Infantry-type unit of the civil guard of regimental or smaller size, and/or Infantry-type unit of the self-defense corps unit of regimental or smaller size of the Vietnamese government during any period such unit was engaged in actual ground combat. f. Assigned as advisor of an irregular force comparable to the above Infantry units under similar conditions.
