Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20100024628 on 7 April 2011. 2. The applicant states he served his country honorably and since his discharge, he has sought self-improvement. For the past 9 years, he have been a Nurse at Carl R. Darnall Army Medical Center at Fort Hood, Texas. He has taken care of Soldiers and their dependents and he was on duty during the shooting on 5 November 2009. He has a desire to enlist in the U.S. Navy Reserve to continue taking care of the military. He has been an honorable citizen during his military career and as a civilian. 3. The applicant provides: a. His DD Form 214, which shows his service from 3 March 1987 to 3 July 1991. b. Six DA Forms 370, completed by co-workers, which rated the applicant’s performance. 4. A review of the applicant’s service record shows: a. He enlisted in the Regular Army on 3 March 1987. He held the military occupational specialty of 11H (Heavy Anti-Armor Weapons Infantryman). He was assigned to Company E, 1st Battalion, 48th Infantry, Germany from 23 June 1987 to 3 July 1991. b. His DD Form 214 shows he was honorably discharged on 3 July 1987, under the provision of Army Regulation (AR) 635-200 (Personnel Separations – Enlisted Personnel), Chapter 4, expiration term of service, assigned a separation designation code (SPD) of JBK and an Reentry Code (RE) of 3C (persons who do not meet the reentry grade and service criteria of AR 601-210). It also shows his character of service as honorable. He completed 4 years, 4 months, and 1 day net active service with no lost time. He was awarded or authorized the: * Army Service Ribbon * Army Achievement Medal * Army Good Conduct Medal (2nd Award) * National Defense Service Medal * Humanitarian Service Medal (2nd Award) * Sea Service Deployment Ribbon (Navy-Marine Corps) with one service star * Navy "E" Ribbon (Navy) * Army Good Conduct Medal (3rd Award) * Naval Expeditionary Medal * Navy Good Conduct Medal * Southwest Asia Service Medal * Noncommissioned Officer Professional Development Ribbon (2) * Marksman Marksmanship Qualification Badge with Grenade Bar * Sharpshooter Marksmanship Qualification Badge with Rifle and Dragon * Gunner Bars * Combat Infantryman Badge 5. The Army Board for Correction of Military Records, by letter, to the applicant on 11 April 2011, denied his request to change his RE from RE-3C to RE-1. 6. By regulation AR 600-200 (Enlistment Personnel Management System), in effect at the time of the applicant's discharge, proved policies and procedures for the management of enlisted personnel. Chapter 4 contained guidance on the Qualitative Management Program and section II contained guidance on Qualitative Retention Program which provided for the use of reenlistment ineligibility points (RIP) for each grade. 7. By regulation AR 601-210 (Regular Army and Army Reserve Enlistment Program) governs eligibility criteria, policies, and procedures for enlistment and processing of persons into the Regular Army (RA) and the Army Reserve (USAR), in effect at the time, covers eligibility criteria, policies, and procedures for enlistment and processing into the RA and the USAR. Table 3-6 shows the list of the RA RE codes. The RE-3C applies to Soldiers who do not meet the reentry grade and service criteria of AR 601-210 and ineligible for enlistment unless a waiver is granted. 8. By regulation AR 635-5 (Separation Documents), in effect at the time, shows the SPD/RE Code Cross Reference, table 2-3. It specified in step 5 to check records for the following disqualifications and assign code as shown: It shows that the RE-3C would be assigned members who failed to meet grade and service requirements. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was not warranted. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board concluded that the applicant failed to show that an error or injustice was present which would warrant making a change to the applicant’s military record. The Board wished to advise the applicant in order to make the requested change, the applicant should provide some justification for the change; currently, that was not given and, therefore, the Board recommended denying the applicant’s request. Table 3-8 included a list of the RA RE codes. • RE-1 applies to Soldiers completing their term of active service who are considered qualified to reenter the Army; they are qualified for enlistment if all other criteria are met • RE-3 applies to Soldiers who are not considered fully qualified for reentry or continuous service at the time of separation, but the disqualification is waivable; those individuals are ineligible unless a waiver is granted • RE-4 applies to Soldiers ineligible for reentry • RE-3C applies to Soldiers who do not meet the reentry grade and service criteria of AR 601-210 and ineligible for enlistment unless a waiver is granted 2. AR 600-200 (Enlistment Personnel Management System), in effect at the time of the applicant's discharge, proved policies and procedures for the management of enlisted personnel. Chapter 4 contained guidance on the Qualitative Management Program and section II contained guidance on Qualitative Retention Program which provided for the use of reenlistment ineligibility points (RIP) for each grade. The RIP was the maximum number of years of active Federal service authorized for a Soldier in a specific grade. It stipulated that reenlistment or extension of members in grade E-4 would not exceed 10 years and 13 years for those in the grade E-5. 3.
