The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states her DD Form 214 only list one ARCOM and one AAM, but she has two of each. It also does not list her CAB, her COA, or her time served with the USAR. She received the CAB and second ARCOM after she was released from active duty, but she was not aware she could request a change until recently. 3. The applicant provides: a. A COA, dated 26 November 2003, for serving magnificently as a member of the 593rd Corps Support Group Color Guard. b. DA Form 638, dated 18 November 2003, for her first AAM. The document contains signatures, but no permanent order number, also for serving as a member of the 593rd Corps Support Group Color Guard. c. DA Form 638, her first ARCOM for outstanding performance and leadership ability that contributed to the success of the Battalion S-4 Logistics Section Area. The accompanying certificate has Permanent Order (PO) #240-006. d. DA Form 638 with PO #213-004, dated 29 June 2005, her second AAM for exceptional achievement while volunteering for the unit’s cook out from 14 June 2005 to 16 June 2005 with the accompanying certificate. e. DA Form 638 with PO #240-006, dated 18 July 2005, her second ARCOM for meritorious service while assigned to the 593rd Corps Support Group from January 2003 to August 2005, with the accompanying certificate. Block 8 (Previous Awards) does list an ARCOM and AAM (1OLC). f. PO 238-22, dated 26 August 2005, awarded the applicant the CAB for actively engaging or being engaged by the enemy on 9 August 2004. g. Orders 10-110-00043, dated 20 April 2010, honorably discharged the applicant from the USAR. 4. A review of the applicant’s service record shows: a. She enlisted in the Regular Army on 20 August 2002. b. She served in Kuwait and Iraq from 16 June 2004 to 1 December 2004. c. On 19 August 2005, she was honorably released from active duty. Her DD Form 214 shows she completed 3 years of active service. It also shows she was awarded or authorized: * Army Commendation Medal * Army Achievement Medal * National Defense Service Medal * Iraq Campaign Medal * Global War on Terrorism Service Medal * Army Service Ribbon * Overseas Service Bar (2nd Award) 5. A review of her service record confirms she is eligible for awards that are not recorded on her DD Form 214. These awards will be added to her DD Form 214 as administrative corrections and will not be considered by the Board. The Board will consider her request for the COA and her time in the USAR to be reflected on her DD Form 214. 6. By regulation (AR 635-5), the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. a. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. b. Awards and decorations will be listed for all periods of service in the priority sequence specified in Army Regulation (AR) 600-8-22 (Military Awards). AR 600-8- 22 gives the order of precedence for awards and decorations. Only decorations, medals, and ribbons are listed. Certificates of achievement, letters of appreciation, and similar documents are not listed. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined partial relief was warranted. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board found that the applicant had previously received an ARCOM, AAM and CAB which are not reflected on his DD Form 214 and warranted correction. However, the Board also found that a Certificate of Achievement is not something that should be reflected on a DD Form 214 based upon regulatory guidance. Additionally, the Board wished to inform the applicant that only active duty service is reflected on a DD Form 214. Therefore, the Board recommended denying the portion of the request related to adding a COA and his service in the USAR to the DD Form 214. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 adding the Army Commendation Medal, Army Achievement Medal and Combat Action Badge. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to adding additional service time and the Certificate of Achievement. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
