The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his name as "XXXXX, XXXX XXXXX" instead of "XXXX XXXXX XXXXX." 2. The applicant states his first and middle names were inverted on his DD Form 214. THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records with supporting document(s): * Certification of Birth * DD Form 214 2. Evidence from the applicant’s service record and Department of the Army and Department of Defense records and systems: * DD Form 398 (Statement of Personnel History), dated 12 February 1966 * DD Form 47 (Record of Induction), 14 January 1966 * DD Form 214 REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. The DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. DISCUSSION: 1. On 12 February 1966, two days prior to his induction, the applicant completed a DD Form 398, wherein he recorded and signed his name using "XXXX" as his first name and "XXXX" as his middle name. 2. The applicant was inducted into the Army of the United States on 14 February 1966, His DD Form 47 show his name as "XXXXX, XXXXX XXXXX." 3. He was released from active duty on 13 February 1968. His DD Form 214 recorded his name as "XXXXX, XXXXX XXXXX" and his signed this document with the signature "XXXXXX X. Xl." 4. He provides a copy of his Certification of Birth, issued on 5 February 1986, which shows his name as "XXXXl, XXXXX XXXXXX." BOARD DETERMINATION/RECOMMENDATION: 1. The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. 2. A copy of this decisional document will be filed in his records to clarify the difference between the first and middle name listed in his records and the name he is currently using.
