ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 4 September 2019 DOCKET NUMBER: AR20170010720 APPLICANT REQUESTS: his Reentry Code (RE) be changed from a “3” to a “1” on his DD Form 214 (Certificate of Release or Discharge from Active Duty) APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he was separated from the Officer Commission Program allegedly, for not having a correct packet built and he was given a Reentry Code (RE) of “3.” He will need a RE code waiver in order to reenter into the Army and for this process to occur he needs a discharge packet completed, in which he does not have. He is requesting to have his RE code changed from a “3” to a “1.” He was not given the necessary documentation and he did not build his own packet. 3. A review of the applicant’s service record shows: a. He enlisted in the Regular Army on 26 March 1993. b. The facts and circumstances surrounding the applicant’s service records to include his initial enlistment contract, promotion orders, Officer Program Application, circumstances surrounding the reasoning for his RE Code 3 instead of 1, and any other service records, are not available in his personnel electronic records management system (IPERMS) or official personnel records for the Board to review. c. His DA Form 1059, Service School Academic Evaluation Report, shows he attended the Primary Leadership Development Course (PLDC) for the period of 29 May 1996 to 27 June 1996 and was rated as exceeding course standards. d. Orders Number 263-9 shows he was promoted on 19 September 1996 to the grade of Sergeant/E-5 shortly after his completion of PLDC. e. He was discharged on 3 September 1997. His DD Form 214 shows he was discharged under the provisions of Army Regulation 635-200 (Active Duty Enlisted Administrative Separations), paragraph 16-2, with an honorable characterization of service. He completed 4 years, 5 months and 8 days of net active service. Item 25 shows his Separation Code as KGX and item 27 shows his RE Code as “3.” His DD Form 214 also shows he was awarded or authorized the: * Army Achievement Medal * Army Good Conduct Medal * National Defense Service medal * Noncommissioned Officer’s Professional Development Ribbon * Army Service Ribbon * Overseas Service Ribbon 4. By regulation, (AR 635-5-1 (Separation Program Designator (SPD) Codes) Soldiers discharged under paragraph 16-2 specify the narrative reason for discharge as "Enter Officer Training Program" and that the authority for separation under this SPD code was paragraph 16-2. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. The applicant’s contentions were carefully considered. He received a SPN Code of KGX and a RE Code of 3 after separating to enter the officer training program. A review of AR 635-5, table 2-3, in effect during the period of his service shows the cross reference RE Code for SPN Code KGX is “3.” The Board agreed there was no error or injustice in this case as he was provided the appropriate RE Code upon separation. RE Code 3 represents he may reenter with a waiver. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-200, paragraph 16-2 (Personnel Separations Enlisted Personnel), in effect at the time, states that members enlisted personnel may be discharged for the purpose of acceptance into a senior ROTC Program (Military Science III-IV), OCS, or another program requiring enlistment in a Reserve Component of the Army or any component of another branch of the Armed Forces. These programs must lead to a commission or appointment with immediate order to AD in such status upon successful completion of the program. Discharge from Active Army status for acceptance into the advanced course of SROTC is de pendent on immediate enlistment in the USAR for assignment to a Control Group (ROTC) and presentation of a letter of acceptance from an ROTC host institution. 3. Army Regulation 635-5-1 (SPD Codes), prescribe the specific authorities and the reasons for the separation of members from active military service and the SPD codes to be used for these stated reasons. The regulation in effect at the time of the applicant's discharge stated that the SPD code KGX, as shown on the applicant's DD Form 214, specified the narrative reason for discharge as "Enter Officer Training Program" and that the authority for separation under this SPD code was paragraph 16-2 or b of Army Regulation 635-200. The SPD code KDX pertained to Soldiers entering onto an officer training program. 4. Army Regulation 635-5 (Personnel Separations Separation Documents), in effect at the time, prescribes the separation documents that will be furnished each individual who is separated from the Army including active duty training personnel and cadets from the US Military Academy. The purpose of a separation document is to provide the individual with documentary evidence of his military service. //NOTHING FOLLOWS//
