ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 5 August 2019 DOCKET NUMBER: AR20170010837 APPLICANT REQUESTS: Correction of his DD Form 214 (Certificate of Release or Discharge) by adding the Kuwait Liberation Medal (Kuwait). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: He provides a DD Form 149 (Application for Correction of Military Record). FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he served in Kuwait during the required time period for award of the Kuwait Liberation Medal (Kuwait). His service records will validate the time-frame and that he was deployed to Kuwait. 3. Review of the applicant’s service record shows: a. He enlisted in the Regular Army on 25 August 1987. He served continuously on active duty through several reenlistments and in various assignments. He served in Saudi Arabia from 8 January 1991 to 11 May 1991. b. He was honorably released from active duty on 28 February 1992 and was transferred to a Reserve unit. His DD Form 214 shows he completed 4 years, 6 months, and 4 days of active service. This form also shows he was awarded/authorized the: * Army Service Ribbon * National Defense Service Medal * Army Lapel Button * Army Good Conduct Medal * Driver Badge with “W” and “T” Bars * Southwest Asia Service Medal with three bronze service stars * * Noncommissioned Officer Professional Development Ribbon with Numeral 2 * Army Achievement Medal with oak leaf cluster (OLC) * Army Commendation Medal with second OLC 4. By regulation (AR 600-8-22), the: * Kuwait Liberation Medal (Saudi Arabia) was awarded to service members who participated in the Persian Gulf War between 17 January 1991 and 28 February 1991 * Kuwait Liberation Medal (Kuwait) was awarded to service members who participated in the Persian Gulf War between 2 August 1990 and 31 August 1993 BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was warranted. The applicant’s contentions were carefully considered. The evidence of record shows he is authorized two decorations for his service in Southwest Asia as provided by regulatory guidance. The Board agreed both decorations should be added to his DD Form 214. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The regulation states the: a. Kuwait Liberation Medal (Saudi Arabia) was approved on 3 January 1992 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 17 January 1991 and 28 February 1991. b. Kuwait Liberation Medal (Kuwait) was approved on 9 November 1995 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 2 August 1990 and 31 August 1993.
