The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he would like his primary MOS time to show time in Special Forces MOS 18 Series and Infantry 11B on his DD Form 214. At no time did he hold a primary MOS of Indirect Fire Mortar Infantry 11C, in his 20 years in service, majority of service was in special force assignment. 3. The applicant provides: a. DA Form 2-1, Part VII, Item 35 (Current and Previous Assignments) which shows duty MOS as: * 11B from 20 September 1971 to 3 June 1984 * 18B Air Operations Noncommissioned Officer from 1 June 1985 to 11 February 1986 * 18Z (Principal Drill Instructor and Operations Sergeant) from 12 February 1986 to 1 March 1990 b. DD Form 214, which shows he was honorably discharged for immediate reenlistment on 22 November 1973, and Item 23a (Specialty Number and Title) – 11B2P Light Weapons Infantryman. He completed 2 years, 4 months, and 24 days of active service. c. DD Form 214, which shows he was honorably retired on 30 June 1991. It also shows Item 11 (Primary Specialty) 11C50 (Indirect Fire Infantryman). He completed 13 years, 7 months and 22 days of net active service, 6 years, 4months, and 9 days of prior active service, 1 year, 11 months, and 24 days foreign service. Item 21 (Signature of Member Being Separated) –Soldier not available to sign. 4. A review of the applicant’s service record shows: a. He enlisted in the Regular Army on 29 June 1971. He completed required training and held the primary specialty of 11B (Light Weapons Infantryman). He completed 16 weeks of Special Forces Course in 1978. b. His Orders Number 64-58, dated 7 April 1986, issued by Headquarters, XVIII Airborne Corps and Fort Bragg awarded PMOS 18B4V SMOS: 11B40, AMOS: 11C40 and withdrew PMOS 18B40 SMOS: 11C40. d. His Orders Number 72-4, dated 16 May 1989, issued by Headquarters, United States Army 1st Special Operations Command (Airborne) Fort Bragg, NC awarded the primary MOS (PMOS) 11C50 effective 15 May 1989 and withdrew PMOS 18Z50. e. He was honorably retired on 30 June 1991. His DD Form 214 shows he completed 13 years, 7 months, and 22 days of net active service; 6 years, 4 months, and 9 days of prior active service; 1 year, 11 months and 24 days foreign service. It also contains the entry Item11 (Primary Specialty) 11C50 Indirect Fire Infantryman 2 years, 2 months//11B50 Infantryman 19 years, 6 months//NOTHING FOLLOWS. Item 21 Signature of Member Being Separated –Soldier not Available to Sign. It also shows he was awarded or authorized: * Army Service Ribbon * Special Forces Tab * Army Commendation Medal * Ranger Tab * Master Parachutist Badge * Expert Infantryman Badge * Egyptian Parachutist Badge * Army Good Conduct Medal (7th Award) * Army Lapel Button * Noncommissioned Officer Professional Development Ribbon (3) * Meritorious Service Medal * National Defense Service Medal 5. By regulation AR 635-5 (Separation Documents) states to enter the titles of all MOS's in which served for at least 1 year and to include the number of years and months served for each MOS. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was not warranted. Based upon the orders, dated 16 May 1989, within the applicant’s military personnel file showing he was awarded the MOS of 11C as the primary MOS and his previous primary MOS of 18Z was withdrawn, the Board concluded that his information on the DD Form 214 was correct and warranted no correction. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), governed the preparation of the DD Form 214. The DD Form 214 is a summary of a soldier’s most recent period of continuous active duty. It provides a brief, clear cut record of active duty service at the time of release from active duty, retirement, or discharge. It states for item 11 (Primary Specialty), (for enlisted Soldiers), from the Enlisted Record Brief, enter the titles of all MOS for at least 1 year and include for each MOS the number of years and months served.
