Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that line of duty (LOD) documents be moved from the restricted folder of his official military personnel file (OMPF) to the medical folder. 2. The applicant states, in effect, he has documents that detail an LOD investigation in his OMPF. The incident happened when he was injured in the field; there is no derogatory information in the LOD. He believes the documents should be filed in his medical folder. He does not believe this had a negative outcome when the sergeant first class board convened. He was advised to have the LOD moved to his medical folder. He went to his S-1, Personnel Administrator and was given the website to the Army Board for Correction of Military Records (ABCMR) for removal. 3. The applicant provides no additional information in support of his request. CONSIDERATION OF EVIDENCE: 1. The applicant is currently serving in the Regular Army in the rank/grade of staff sergeant (SSG)/E-6. 2. The restricted folder of the applicant's OMPF, within the interactive Personnel Electronic Records Management System (iPERMS), contains five pages of documents concerning his LOD investigation/status. These documents are: a. His Enlisted Record Brief, dated 10 January 2007. b. A DA Form 2173 (Statement of Medical Examination and Duty Status), dated 16 January 2007, which details the applicant's injury he sustained while chopping wood during rotational support mission. c. A memorandum for Commander, 11th Armored Cavalry Regiment, Fort Irwin, Fort Irwin, CA, dated 17 January 2007, wherein the commander concurred with the unit troop commander and did not recommend a formal investigation. d. A memorandum for Commander, National Training Center and Fort Irwin, Fort Irwin, CA, dated 24 January 2007, reviewed the applicant's LOD. e. A memorandum for Commander, US Army Soldier Records Data Center, Indianapolis, IN, dated 13 February 2007, approved the applicant's LOD. REFERENCES: Army Regulation 600-8-104 (Army Military Human Resource Records Management) prescribes the policies governing the OMPF, military personnel records jacket, career management individual file, and Army personnel qualification records. It states: a. The restricted folder contains documents that may normally be considered improper for viewing by selection boards or career managers. Includes masked documents as defined in this regulation. Per appendix B (Documents Required for Filing in iPERMS), LOD documents are filed in the restricted folder. b. The medical folder contains health information, such as accession/retention/separation medical documents and periodic health assessments. c. Paragraph 3-6 of this regulation states that once a document is placed in the OMPF it becomes a permanent part of that file and will not be removed from that file or moved to another part of the file unless directed by the proper authorities listed in the regulation. DISCUSSION: In accordance with applicable regulation, documents concerning a Soldier's LOD status will be filed in the restricted folder within iPERMS.
