The applicant states his promotion is being withheld, due to his entry date being pushed back. When he was branched into the Chaplain Corps, he filled out a second DA Form 71 and the date on that form is now his entry day, instead of the previous form. 2. The applicant provides a copy of his DA Form 71, dated 1 May 2015. 3. A review of the applicant’s service record shows: a. He enlisted in the U.S. Army Reserve as a Reserve Officer's Training program (ROTC) cadet on 22 August 2012. A Bachelor of Arts, Religion Major, was conferred on the applicant on 2 May 2015. b. His appointment scroll was approved on 5 February 2015 for appointment in the grade of second lieutenant (2LT). He was discharged from the USAR (ROTC) on 1 May 2015. c. On 1 May 2015, he was appointed as a commissioned officer in the United States Army Reserves (USAR) in the rank/grade of 2LT/O-1. He executed an oath of office on that date. d. On 13 January 2016, the applicant submitted a DA Form 61 (Application for Appointment) requesting to be appointed as a Reserve commissioned officer in the Chaplain Corps. e. On 9 May 2016, he was issued a memorandum appointing him as a Reserve commissioned officer in AOC (area of concentration) 56X (Chaplain Candidate). His appointment memorandum stated: Your primary Specialty Skill Identifier (SSI) is shown after B (56X). The Army regulation pertaining to your appointment is shown after C (Army Regulation (AR) 135-100). If you have been credited with "years of service in an active status" the number of years, months, and days is shown after D (zero years, zero months, and zero days) (applies only to Chaplains, Medical personnel and the Judge Advocate General's Corps). This service is not valid for pay entry basic date and it is not the result of prior military service f. He entered active duty for training (ADT) on 20 May 2017 and completed the Chaplain Basic Officer Leader Course from 21 May 2017 to 18 August 2017. He was honorably released from ADT on 18 August 2017. g. Orders B-11-707487, issued by Headquarters, U.S. Army Human Resources Command (HRC), dated 15 November 2017, shows he was promoted to the rank/grade of 1LT/O-2 in the USAR on 15 November 2017. h. On 1 April 2019, the applicant was ordered to active duty for 36 months. He was ordered to report to the 2nd Squadron, 1st Armor to fulfil his active duty requirements in a voluntary indefinite status. i. On 7 May 2019, the U.S. Army Human Resources Command published orders appointing the applicant in the Regular Army Chaplain Corps under title 10, U.S. Code, sections 531, 532, 533, and 3064, in the grade of 1LT. The effective date of this Regular Army appointment is on the execution of the oath of office. Any existing or Reserve appointment as a commissioned or warrant officer is vacated upon the acceptance of this appointment. 4. By regulation (AR 135-100), applicants with prior service as chaplains in any component of the Armed Forces of the United States must meet the requirements. Applicants for initial appointment in ranks above second lieutenant and former officers without prior service as chaplains must possess a baccalaureate degree of not less than 120 semester hours from a college that is listed in the Education Directory, Colleges and Universities or from a school whose credits are accepted by a college listed therein, must have completed 3 resident years of graduate professional study in theology or related subjects (normally validated by the possession of a Master of Divinity or equivalent degree or 90 semester hours), that lead to ecclesiastical endorsement as a member of the clergy fully qualified to perform the ministering functions of a chaplain, at a graduate school listed in the Education Directory Colleges and Universities or an accredited school listed in the directory or at a school whose credits are accepted by a school listed as accredited in these two documents. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was warranted. The applicant’s contentions were carefully considered. Evidence of record shows he accepted a commission to 2LT on 1 May 2015; however, his DD Form 214 for the period ending 18 August 2017 shows his date of rank to 2LT as 16 May 2016. The Board agreed the error should be corrected on his DD Form 214 and any other pertinent documents within his records. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. adjusting his date of rank to 2LT to show 1 May 2015 b. adjusting his date of rank to 1LT to show 1 November 2016 c. amending his DD Form 214 for the period ending 18 August 2017 by showing his rank as 1LT/O-2 and the date of rank as “2016 11 01”; d. consideration for promotion to the rank of captain/O-3 based on the adjusted date of rank to 1LT. Army Regulation 135-100 (Appointment of Commissioned and Warrant Officers of the Army) prescribes policy and procedures for the appointment of commissioned and warrant officers in the Army National Guard of the United States (ARNGUS) and the United States Army Reserve (USAR). Paragraph 1-9 provides for the grade on appointment. It states if otherwise qualified, applicants may be appointed in grades indicated. a. Commissioned officers. Applicants for direct appointment will not be appointed above the grade of second lieutenant. (b) Have completed 3 resident years of graduate professional study in theology or related subjects (normally validated by the possession of a Master of Divinity or equivalent degree or 90 semester hours), that lead to ecclesiastical endorsement as a member of the clergy fully qualified to perform the ministering functions of a chaplain, at a graduate school listed in the Education Directory Colleges and Universities or an accredited school listed in the Directory, ATS Bulletin Part 4 or at a school whose credits are accepted by a school listed as accredited in these two documents. (c) As an exception to (b) above, a senior seminary student may apply 180 days before graduation and ordination. This is provided the request is for appointment with concurrent AD. Along with the transcript of undergraduate credits, an applicant must submit a consolidated transcript of graduate credits completed at the time of application. Army Regulation 135-155 (Promotion of Commissioned Officers and Warrant Officers Other than General Officers) states, in pertinent part, that the effective date of promotion for commissioned officers may not precede the date on which the promotion memorandum is issued and the promotion memorandum will not be issued before the date the promotion board results are approved and confirmed by the Senate (if required).
