The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. Applicant states she needs the requested updated DD Form 213 for the 166th HQ Delaware Air National Guard Unit and for Liberty University Project Management Master’s Program. 3. A review of the applicant’s service record shows: a. The applicant’s DD Form 4 (Enlistment Record – Armed Forces of the United States) shows she enlisted into the United States Army Reserves (USAR) on 1 April 2009, in the rank/grade of SPC/E-4 under the name “X__ X__ X__. She signed her coX__ X__ X__. documents using this name. b. She entered active duty for training (ADT) on 8 June 2009 and completed training for award of military occupational specialty (MOS) 88H (Cargo Specialist). She was honorably released from active duty on 26 October 2010. Her DD Form 214 shows in: * Item 1, her last name as X__ * Items 4a and 4b, SPC/E-4 * Item X__as separated at Fort Eustis, VA * Item 11, she held MOS 88H Cargo Specialist, 0 years and 0 months * Item 12b, she was separated on 26 October 2010 * Item 12i, the effective date of her E-4 pay grade as 1 April 2009 * Item 13, she was awarded the National Defense Service Medal, Global War on Terrorism Service Medal, and Army Service Ribbon * Item 14, she completed the 8-week Cargo Specialist Course in 2010 c. Orders 11-014-00079, dated 14 January 2011, reassigned her to the 509th Transportation Detachment, West Palm Beach, FL effective 14 January 2011. Her last name is shown as X__ and her rank as SPC. d. Orders 12-X__, dated 21 February 2012, reassigned her to the 430th Transportation Company, Baltimore, MD effective 26 February 2012. Her last name is shown as X__ and her rank as SPC. e. Her DD Form 93 (X__ Emergency Data), completed on 14 July 2013, shows her last name as X__. f. Certificate of Training, signed on 21 NovX__3 (after her release from active duty) shows she completed Structured Self Development on 21 November 2013. g. Noncommissioned Officer Evaluation Report, for the rating period 1 April 2015 through 30 march 2016 shows her rank as SGT/E-5 with a date of rank as 1 April 2015. h. She was honorably discharged from the USAR on 20 June 2017. The discharge orders show her rank as SGT and her last name as X__. i. The applicant’s records are void of any documenX__th her requested name “X__ X__ X__.” The record is also void of any request to change hX__ X__ X__o her release from active duty. 4. The applicant provided: a. State of Florida marriage certificate showing the applicant was married on 9 February 2007. b. Military and Civilian education records, and a9 rd certificates received by the applicant after the end date, 26 October 2010, of her DD Form 214. 5. By regulation (AR 635-5, (Personnel Separations – Separation Documents), a DD Form 214 is a synopsis of the Soldier’s most recent period of continuous active duty. a. Block 1, enter name in all capitals, compare Enlisted Record Brief to contract for possible name change. There is no indication she changed her last name while on active duty. b. Blocks 4a and 4b, (Grade, Rate or Rank), to enter active duty grade or rank and pay grade at time of separation from Enlisted Record Brief. There is no evidence she was advanced to SGT/.E-5 while on active duty. c. Block 8b, (Station Where Separated) enter location where Soldier is transitioning, include state or country. The evidence shows she was separated at Fort Eustis, VA d. Block 11 (Primary Specialty), for an enlisted Soldier, specify the first five characters of the primary MOS code, including the three characters of the MOS, the fourth character of skill and grade level in MOS, and the fifth character of a special qualification identifier (SQI), if applicable. the evidence show she completed the 8-week cargo Specialist training and awarded this MOS. e. Item 12b,(Separation Date This Period) the Soldier’s transition date. This date may not be the contractual date if Soldier is separated early, voluntarily extends, or is extended for make up of lost time, or retained on active duty for the convenience of the government. the evidence shows she was honorably released from active duty for training on 26 October 2010. n f. Item 12i,(Effective Date of Pay Grade), from the most recent promotion order (or reduction instrument), enter the effective date of promotion to the current pay grade. The evidence shows she may have been promoted to SGT in the USAR, but while on active duty, she held the rank/grade of E-4 with an effective date of September 2009. g. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), list awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22. Each entry will be verified by the Soldier's record. There are no provisions in Army regulations for the recording of certificates of achievement, letters of appreciation or commendation, and similar documents on the DD Form 214. There is no evidence she was award the requested awards during her active duty time. h. Item 14 (Milihtary Education), list in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. Include title, length in weeks, and year completed. This information is to assist the soldier in job placement and counseling; therefore, the regulation instructed the preparer not to list training courses for combat skills. The evidence shows she only completed the 8-week cargo Specialist Course while on active duty. 6. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation (from active duty). BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was not warranted. Board members noted that the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board concluded that the information entered thereon reflects the conditions as they existed at the time of separation (from active duty). What the applicant is requesting happened or may have happened outside the period covered by the DD Form 214. Therefore, the Board recommended denying the applicant’s requested relief. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. AR 635-5, provides a DD Form 214 is a synopsis of the Soldier’s most recent period of continuous active duty. It provides a brief, clear cut record of active Army service at the time of release from active duty, retirement, or discharge. The regulation further states, in part, a DD Form 214 will be prepared for reserve component (RC) Soldiers completing 90 or more days of active duty for special work (ADSW), temporary tours of active duty TTAD) or Active Guard Reserve (AGR) service. 3. Army Regulation 635-5 (Separations Documents), in effect during the applicant's active duty service, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. The regulation provided that in: a. Item 1 (Name), enter in all capitals, include “SR,” “JR” or “II” if appropriate. Compare ERB/ORB to contract for possible name change. b. Item 4a and 4b, (Grade, Rate or Rank), to enter active duty grade or rank and pay grade at time of separation from ERB/ORB. c. Item 8b, (Station Where Separated) enter location where soldier is transitioning, include state or country. d. Item 11 (Primary Specialty), for an enlisted Soldier, specify the first five characters of the primary MOS code, including the three characters of the MOS, the fourth character of skill and grade level in MOS, and the fifth character of a special qualification identifier (SQI), if applicable. e.
