The applicant states, in effect, a. She was called to active duty (AD) for two years, not to active duty for training (ADT). The person who typed her DD Form 214 was unfamiliar on how to complete the form, so she asked for assistance, but no one did because they were too busy. b. He is a trained as a 42A; therefore, her DD Form 214 should reflect “42A/Human Resources Specialist” and she should have other awards listed on her DD Form 214, which includes the one she was awarded during his two year tour. 2. The applicant provides: a. Active Duty Orders A-06-405545, dated 10 June 2014, reflects she was ordered to active duty for operational support, with the report date of 16 June 2014, for a period of 365 days and an end date of 15 June 2015. Authority cited: 10 U.S.C. § 12301(D) b. Active Duty Orders HR-5125-00018, dated 5 May 2015, reflects she was ordered to active duty for operational support, with the report date of 16 June 2015, for a period of 365 days and an end date of 14 June 2016. Authority cited: 10 U.S.C. § 12301(D) c. Amendment Orders HR-5125-00018A01, dated 19 May 2015, reflects her active duty orders (HR-5125-00018) was changed from duty at “Norfolk, VA” to “Washington DC.” Authority cited: 10 U.S.C. § 12301(D) d. MOS Orders 12-303-00036, dated 29 October 2012, reflects she was awarded the Primary MOS (PMOS) of 42A and withdrawn the PMOS of 88H, with the effective date of 29 October 2012. e. DA Form 638 (Recommendation for Award), undated, reflects she was recommended for an Army Achievement Medal (AAM) as her permanent change of station (PCS) award, with the proposed presentation date of 15 June 2015. The DA Form 638 was signed by the recommender and the District Commander; however, Part V (Orders Data) was blank. 3. A review of the applicant’s service record shows: a. She enlisted in the Army Reserve on 11 October 2011, as a prior former member of the Armed Forces having no remaining statutory military service obligation and in the military occupational specialty of 42A (Human Resources Specialist). b. On 29 October 2012, she was awarded the PMOS of 42A and the PMOS of 88H was withdrawn. c. She was ordered to active duty effective 16 June 2014 for a period of 365 days and, prior to the end date, she was ordered to active duty effective 16 June 2015 for an additional 365 days, with an end date of 14 June 2016. d. She was honorably released from active duty training (ADT) on 14 June 2016. Her DD Form 214 shows she was released under the provisions of AR 635-200, chapter 4, completion of required active service. It also shows in block 11 (Primary Specialty), 88H Cargo Specialist, block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) she was authorized the National Defense Service Medal (2nd Award), and block 23 (Type of Separation), Released from ADT. e. The applicant’s record does contain a copy of an approved DA Form 638 for the award of the Army Achievement Award, but it is void of a permanent order number. 4. Army Regulation (AR) 600-8-22, prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The goal of the total Army awards program is to foster mission accomplishment by recognizing excellence of both military and civilian members of the force and motivating them to high levels of performance and service. 5. Army Regulation (AR) 635-5 (Separation Documents) prescribes the separation documents that must be prepared for soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214 (Certificate of Release or Discharge from Active Duty). 6. 10 U.S.C. § 12301 (Reserve Components generally) (d) states, at any time, an authority designated by the Secretary concerned may order a member of a reserve component under his jurisdiction to active duty, or retain him on active duty, with the consent of that member. However, a member of the Army National Guard of the United States or the Air National Guard of the United States may not be ordered to active duty under this subsection without the consent of the governor or other appropriate authority of the State concerned. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was warranted. Based upon HQ, 63d RSC Orders# 12-303-00036, dated 29 October 2012, the Board recommended a change to the applicant’s DD Form 214 to show her MOS as 42A. The applicant also had HRC Orders# A-06-405545, which shows her narrative reason for sepration should read “Release from Active Duty”. Finally, since the DA Form 638 provided by the applicant was already approved (but missing the order Number), as well as the level of the specific award involved, the Board elected to grant relief by adding an AAM to the applicant’s DD Form 214. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending her DD Form 214 for the period ending 14 June 2016, by: * (Block 11) change from 88H Cargo Specialist to 42A Human Resources Specialist, * (Block 13) add Army Achievement Medal, and * (Block 28) change from “Release from ADT” to “Release from Active Duty” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. Information on various civilian awards is found in AR 672–20. a. Paragraph 3-19a, states the DA Form 638 will be used to initiate, process, and approve award recommendations of all U.S. Army individual decorations, to include valor and heroism decorations. b. Paragraph 3-19e, states permanent award orders are an authorized part of the DA Form 638. Permanent award orders authority may be delegated to award approval authorities who would not normally publish permanent orders. This delegation should be in writing. Approved awards of the Medal of Honor and Distinguished Service Cross will be confirmed in Department of the Army General Orders. c. Table 3-2 (Steps for preparing and processing awards using the DA Form 638), provides the step-by-step instructions on processing awards: * Step 27 (Personnel Administration Center (PAC)/Admin Clerk): If award is approved or upgraded, prepare Part V, orders data to include issuing headquarters block, permanent orders number, date and approved award. * Step 28 (PAC/Admin Clerk): Print orders approval authority’s name and grade in block provided. * Step 29 (Adjutant): Sign orders approval authority block (adjutant or commander designee). 2. Army Regulation (AR) 635-5 (Separation Documents) prescribes the separation documents that must be prepared for soldiers on retirement, discharge, release from active duty service, or control of the Active Army. a. Paragraph 2-1 states the DD Form 214 is a summary of a soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. The DD Form 214 is not intended to have any legal effect on termination of a soldier's service. b. Paragraph 2-1a (2), states a DD Form 214 will be prepared for each Soldier. Reserve component (RC) Soldiers completing 90 days or more of continuous active duty for training (ADT), Full-Time National Guard Duty (FTNGD), active duty for special work (ADSW), temporary tours of active duty (TTAD), or Active Guard Reserve (AGR) service, except as specified in subparagraphs (3) through (5).
