The applicant requests correction of his records to show the social security number (SSN) XXX-XX-XXXX instead of XXX-XX-XXXX. 2. The applicant states his previous SSN was XXX-XX-XXXX, but his father had the same number. Once the social security administration was contacted, they had him apply for his own number, which he has had for over 20 years now. The number that was given to him is on file at the Department of Veterans Affairs (VA) at Fort Bragg, NC. THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records. 2. Evidence from the applicant’s service record and Department of the Army and Department of Defense records and systems: * DD Form 4 (Enlistment or Reenlistment Agreement – Armed Forces of the United States), dated 25 July 1978 * DD Form 1966 (Application for Enlistment – Armed Forces of the United States), dated 25 July 1978 * DA Form 2-1 (Personnel Qualification Record – Part II) * DD Form 93 (Record of Emergency Data), dated 15 October 1980 * DD Form 1407 (Dependent Medical Care), dated 9 June 1981 * DD Form 214 (Certificate of Release or Discharge from Active Duty), for period ending 24 July 1981 REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Personnel Separations – Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service. It establishes standardized policy for the preparation of the DD Form 214. The DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. DISCUSSION: 1. While the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 25 July 1978. His enlistment document shows his SSN as XXX-XX-XXXX. In connection with his enlistment, he and his recruiter completed DD Form 1966. This form shows his SSN as XXX-XX-XXXX. He authenticated these documents with his signature. 3. His DA Form 2-1, which was created upon his enlistment, shows his SSN as XXX-54-XXXX. His record contains DD Form 93 and DD Form 1407, which show his SSN as XXX-XX-XXXX. He authenticated these documents with his signature. 4. He was honorably released from active duty on 24 July 1981. His DD Form 214 lists his SSN as XXX-XX-XXXX. He authenticated this form with his signature. 5. The applicant contends his SSN should be amended to XXX-XX-XXXX instead of XXX-XX-XXXX. 6. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge.
