ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS BOARD DATE: 16 April 2019 DOCKET NUMBER: AR20170011703 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 10 February 2006, to show his social security number (SSN) as "XXX-XX-XXXX" instead of "XXX-XX-XXXX." APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Social Security Card FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant served in the United States Air Force from 30 March to 11 December 2000. The DD Form 214 he was issued upon discharge lists his SSN as "XXX-XX- XXXX." 3. The applicant enlisted in the Army National Guard on 17 September 2003. He entered active duty on 15 August 2004 and he was honorably released from active duty on 10 February 2006. The DD Form 214 he was issued lists his SSN as "XXX-XX- XXXX." 4. All records contained in his Official Military Personnel File list his SSN as "XXX- XX- XXXX." 6. The applicant provides a copy of his Social Security Card issued on 10 September 2014, which lists his SSN as "XXX-XX-XXXX." 7. Army Regulation 635-5 (Separation Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It stated to transcribe the SSN at the time of separation from applicable documents in item 3 (SSN). BOARD DISCUSSION: 1. After review of the application and all evidence, the Board determined relief is not warranted. The applicant’s contention was carefully considered. He served in the USAF and the Army under the same SSN. There is no evidence he used the contended SSN during his period of service. The applicant did not provide information from the Social Security Administration showing the contested SSN was given in error, or that he was issued a new SSN. Regulatory guidance provides the DD Form 214 is a synopsis of the record at the time of separation. Based upon regulatory guidance, the Board determined there is no error or injustice in this case. 2. The applicant is advised that a copy of this decisional document will be filed in his official military personnel file. This should serve to clarify any questions or confusion about the difference in the name recorded in his military records and the name on his birth certificate. Army Regulation 635-5 (Separations Documents), prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
