Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20100028106 on 26 May 2011. 2. The applicant states, in effect, he held an infantry specialty and served in Southwest Asia in 1991 with an infantry unit. Others he served along with at the same place and time received their badges; he did not. He provides support letters as follows: a. On person states he served along with the applicant in the 2nd Battalion, 502nd Infantry, 101st Airborne Division, during Operations Desert Shield/Storm. He understands that the award of Combat Infantry Badge was omitted from the applicant’s DD Form 214. He can confirm that [Applicant] did indeed serve in a combat unit and was deployed into Iraq during the time of hostile action. b. Another person states the applicant reached out to him and he can personally vouch and verify that he served with the applicant during the time and in the same unit. He served as company commander of the unit and he was privy to all the administrative actions that were processed at the company. He even kept a copy of orders for all Soldier in his commander who served in combat and were awarded the Combat Infantryman Badge. Unfortunately, the record that he has ends with the a. letter “M.” But he can still verify that the applicant served during Operations Desert Shield/Storm from September 1990 to April 2991. c. A third individual identifies himself as the unit’s former support platoon leader and states the purpose of his letter is to verify the applicant’s service as an infantryman in the Support Platoon of 2-502nd Infantry, 101st Airborne Division during Operation Desert Shield/Desert Storm. He served as the support platoon leader from April 1990 to May 1991. The applicant arrived to the platoon in the summer of 1990 and remained until after his departure. In August 1990, their unit was ordered to Saudi Arabia as part of Desert Shield and they remained through 31 March 1991. The applicant deployed with the platoon and returned with the platoon serving six months in a combat zone. As the applicant’s platoon leader, he remembers him specifically and he has knowledge of his departure and arrival date back at Fort Campbell, KY. The platoon was even awarded the Drivers Badge for meeting the requirements between dates that include Desert Shield/Desert Storm. 3. Review of the applicant’s service records shows: a. He enlisted in the Regular Army on 14 June 1989. He was trained in and held military occupational specialty 11B (Infantryman). b. He was assigned to Company B, 2nd Battalion, 502nd Infantry Regiment, on 23 August 1991. c. His DA Form 2-1 (Personnel Qualification Record) show she served in Saudi Arabia (Southwest Asia) from 8 September 1990 to 11 April 1991. d. His DA Form 2-1 does not list the Combat Infantryman Badge as an authorized award, and his service record does not contain orders awarding him this badge. e. He was honorably released from active duty on 29 June 1992. His DD Form 214 show she was awarded or authorized: * Army Good Conduct Medal * Army Service Ribbon * Marksman Marksmanship Qualification Badge with Rifle Bar * Expert Marksmanship Qualification Badge with Grenade Bar * Army Lapel Button * National Defense Service Medal * Southwest Asia Service Medal with two bronze service stars * Driver and Mechanic Badge with Driver-W Bar * Air Assault Badge * Parachutist Badge * 5. By regulation (AR 600-8-22), there are basically three requirements for award of the Combat Infantryman Badge: * the Soldier must be an infantryman satisfactorily performing infantry duties * the Soldier must be assigned to an infantry unit during such time as the unit is engaged in active ground combat * the Soldier must actively participate in such ground combat BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was not warranted. Board members did not feel he met all three criteria for this badge. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board found no evidence he actively participated in ground combat. Board members carefully examined the witness statements but none placed him in actual active combat while his unit was engaged with the enemy. REFERENCES: Army Regulation 600-8-22 (Military Awards) the Combat Infantryman Badge is authorized for award for several qualifying wars, conflicts, and operations, including Operation Desert Storm. There are basically three requirements for award of the Combat Infantryman Badge. The Soldier must be an infantryman satisfactorily performing infantry duties, he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and he must actively participate in such ground combat. Specific requirements state, in effect, that an Army enlisted Soldier must have an infantry or special forces specialty and must have satisfactorily performed duty while assigned or attached as a member of an infantry, ranger, or special forces unit of brigade, regimental, or smaller size during any period such unit was engaged in active ground combat.
