APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * SGLV Form 8286 (SGLI Election and Certificate), dated 18 October 2015 * National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service), dated 30 May 2016 * Orders Number 122-1030, dated 2 May 2017 * NGB Form 22A (Correction to NGB Form 22), dated 1 August 2017 FACTS: 1. The applicant states he was erroneously enlisted in the California Army National Guard (CAARNG) and is being charged an SGLI debt. It was a paperwork mishap that took months to fix. 2. A review of the applicant's official records shows the following: a. On 11 May 2010, the applicant enlisted in the Regular Army. In conjunction with this enlistment he completed SGLV Form 8286 selecting $50,000.00 of coverage at the time, and from there renewed annually. b. On 10 March 2015, Orders Number 069-0023, issued by Headquarters, 1st Infantry Division and Fort Riley, KS, reassigned the applicant to the transition point for transition processing. He was assigned to the U.S. Army Reserve (USAR) Control Group (Reinforcement). c. On 15 April 2015, the applicant enlisted in the CAARNG for a period of 1 year, 4 months, and 15 days. d. On 18 May 2015, Orders Number 138-0015, issued by Headquarters, 1st Infantry Division and Fort Riley, revoked Orders Number 069-0023 pertaining to the applicant's release from active duty. e. The applicant's records contain an SGLV Form 8286, dated 10 June 2015, showing his primary beneficiary for a 100 percent share was his wife. f. On 7 July 2015, Orders Number 188-0026, issued by Headquarters, 1st Infantry Division and Fort Riley, reassigned the applicant to the transition point for transition processing. He was assigned to the 11th Forward Support Company, 11th Armored Cavalry Regiment, Burbank, CA, effective on 17 October 2015. These orders show a terminal date of Reserve obligation ending on 2 March 2018. g. On 17 October 2015, the applicant was honorably released from active duty and transferred to the 11th Forward Support Company, 11th Armored Cavalry Regiment. h. On 30 May 2016, the applicant was honorably released from the ARNG and transferred to the USAR Control Group (Reinforcement). NGB Form 22, item 16 (SGLI Coverage) shows $400,000.00. i. On 2 May 2017, Orders Number 122-1030, issued by the CAARNG, honorably discharged the applicant from the ARNG, effective on 18 October 2015. j. On 12 January 2019, NGB Form 22A was issued showing the applicant's effective date of separation was changed from 30 May 2016 to 18 October 2015. 3. The applicant provides a SGLV Form 8286 showing at the time he declined SGLI coverage. 4. See applicable references below. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found that relief is warranted. 2. The Board agreed that although the applicant would properly have been charged SGLI premiums during his ARNG service from October 2014 through May 2016, the correction of his record to show he was discharged after one day of ARNG service effectively voided any SGLI coverage he had subsequent to 18 October 2015. The Board determined the applicant should not be held accountable for any SGLI premiums charged to him after 18 October 2015, the date he was discharged from the ARNG. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by cancelling any debt he incurred as a result of Servicemembers' Group Life Insurance premiums charged to him after 18 October 2015. Requests for remission or cancellation of indebtedness must be based on injustice, hardship, or both. A Soldier's debt to the U.S. Army may be remitted or canceled on the basis of this regulation in cases arising from debts incurred while serving on active duty or in an active status as a Soldier. 2.
