APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * SS card * Veteran affairs (VA) form 21-4138 (Statement in Support of Claim) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his SSN is incorrect on his DD Form 214 and would like it corrected to show his correct SSN. 3. The applicant provides: a. His SSN card shows his SSN as "XXX-XX-XXXX." b. VA Form 21-4138, dated 31 May 2017, shows the applicant informed the VA that his SSN is not correct on his DD Form 214. He states that he has requested for it to be corrected. 4. A review of his service records shows: a. He enlisted in the Oklahoma Army National Guard (OKARNG) of the U.S. on 18 October 1965. His OKARNG Form 23, dated 18 October 1965, shows his SSN as "XXX-XX-XXXX" and his signature. b. His DD Form 214, shows he attended military occupational specialty (MOS) training from 7 July 1966 to 10 November 1966. c. His service records shows his service number, NG “XX XXX XXX.” d. On 10 November 1966, he was honorably released from active duty upon completion of MOS training and returned to the OKARNG state control to complete his remaining service obligation of 5 years. His DD Form 214 shows in item 32 (Remarks), SSN as "XXX-XX-XXXX." 5. By regulation, Army Regulation 635-5 (Personnel Separations - Separation Documents), the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. It stated for entries in item 32, transcribe the social security account number (SSAN) from DA Form 24 (Service Record) in the following manner “SSAN XXX-XX-0000.” BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was warranted. Based upon the requested SSN being a single digit different than that which currently is reflected on the applicant’s DD Form 214, the Board concluded that an administrative error occurred at the time of publication which would warrant making a change to the applicant’s SSN. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 10 November 1966 by showing his social security number as that shown on his social security card. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
