The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he was awarded the Army Achievement Medal (AAM). 2. The applicant states he was issued the AAM Certificate; however, because of a typo in his social security number it was not entered on his DD Form 214. THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records with supporting document(s): * DA Form 4980-18 (AAM Certificate), dated 1 May 1992 * DD Form 214, for the period ending 16 October 1992 * National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service), effective 12 October 1995 * a letter from the U.S. Army Human Resources Command (HRC), dated 13 March 2017 * a printout of his request for the Korea Defense Service Medal (KDSM), dated 14 March 2017 2. Evidence from the applicant’s service record and Department of the Army and Department of Defense records and systems, including his DA Form 20 (Enlisted Qualification Record). REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) provides policy, criteria, and administrative instructions concerning military awards and decorations. It states: a. The AAM is awarded to members of the Armed Forces of the United States, who while serving in a noncombat area on or after 1 August 1981, distinguished themselves by meritorious service or achievement. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required. b. The KDSM is authorized to members of the Armed Forces who have served on active duty in support of the defense of the Republic of Korea from 28 July 1954 to a date to be determined. DISCUSSION: 1. While the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 31 May 1990. 3. The applicant served in the Republic of Korea from on or about 22 October 1990 through on or about 2 November 1991. He was assigned to the 17th Calvary Regiment, 2nd Infantry Division. 4. The applicant was honorably released from active duty on 16 October 1992. His DD Form 214 shows he was credited with 2 years, 4 months, and 16 days of net active service this period. He was awarded or authorized the: * National Defense Service Medal * Army Service Ribbon * Overseas Service Ribbon * Expert Marksmanship Qualification Badge with Pistol (9mm) and Hand Grenade Bar 5. The applicant's record is void of orders or other documentation that indicates he was recommended for or awarded the AAM. He provides an AAM Certificate that shows he was awarded the AAM for meritorious achievement during the period 4 February to 9 February 1991, while serving as a Tank Loader, assigned to the 5th Squadron, 17th Calvary Regiment, 2nd Infantry Division. It is noted that his social security number is incorrectly recorded on the provided AAM Certificate. 6. A letter from HRC, dated 13 March 2017, indicates the applicant is authorized the KDSM; however, his DD Form 214 was not amended to reflect this medal. BOARD DETERMINATION/RECOMMENDATION: The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 (Certificate of Release or Discharge from Active Duty), for the period ending 16 October 1992, to show the Army Achievement Medal and the Korea Defense Service Medal.
