The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 (Certificate of Release or Discharge from Active Duty), block 18 (Remarks) does not reflect his Bosnia Deployment with 642nd Engineer Company. This would take the total number of deployments to seven which is correct, he states the transition specialist left the deployment off by mistake. He provided a copy of his DD Form 214 to show his previous deployments. 3. A review of the applicant’s record shows: a. He enlisted in the Regular Army on 30 January 1992. b. He deployed to Bosnia while assigned to 642nd Engineer Company (CSE), 41st Engineer Battalion, 10th Mountain Division, Fort Drum. c. He received a Multinational Division (North) Commander’s Safety Award for accident free duty performance while in support of Operation Joint Guard in Bosnia- Herzegovina & Croatia from 5 September 1999 to 6 February 2000. d. Order number 053-12, awarded him the Army Achievement Medal for outstanding achievement while assigned as a communication specialist from 7 February 2000 to 17 February 2000. e. On 30 June 2016, his DD Form 214 shows he was honorably released from active duty for sufficient service for retirement. He completed 24 years, 5 months, and 1 day of active service. His DD Form 214 shows in item 12f (Foreign Active Service) 0015 02 23 and block 18 shows his previous deployments from: * Saudi Arabia – 15 July 1993 to 20 November 1993 * Bosnia – 7 January 1996 to 22 November 1996 * Kosovo 28 April 2002 to 11 November 2002 * Iraq – 11 March 2004 to 11 March 2005 * Iraq – 26 October 2006 to 16 January 2008 * Afghanistan – 12 June 2012 to 12 February 2013 4. By regulation, AR 635-5 (Personnel Separations - Separation Documents), the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. The instructions for completing the DD Form 214 states for item 12f (Foreign Active Service), enter the total amount of Foreign Service completed during the period covered. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was not warranted. The applicant’s contentions were carefully considered. Evidence provided shows he served an additional assignment in Bosnia from on or about 5 September 1999 through on or about 17 February 2000. However, the deployment is not shown on his DD Form 214.
