ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 4 October 2019 DOCKET NUMBER: AR20170013083 APPLICANT REQUESTS: his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) reflects his Foreign Service (block 24c) time in Vietnam. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, that he would like to have his DD Form 214 corrected to reflect his duty time in Vietnam. He requested this error be corrected on his DD Form 214 so he can receive appropriate services. 3. A review of the applicant’s service record shows the following: a. He was inducted into the Army of the United States on 23 October 1963. b. DA Form 20 (Enlisted Qualification Record) shows in: (1). Block 29 (Foreign Service) * Okinawa, Japan from 10 June 1964 to 4 May 1965 * 5 May 1964 to 11 October 1965 ( Oversea Command not reflected) c. DA Form 24 (Service Record) shows in: (1). Section 5 (Service Outside Continental United States) * Okinawa, Japan from 10 June 1964 to 4 May 1965 * Vietnam from 5 May 1964 to 11 October 1965 d. He was transferred to the United States Army Reserves (USAR) on 13 October 1965. His DD Form 214 shows that he was discharged with an honorable character of service. He completed 1 year, 11 months, and 21 days of active service. Block 24c (Foreign Service) shows 1 year 4 months and 2 days of Foreign Service. 4. Army Regulation (AR) 635-5 (Separation Documents) DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty).will be issued to provide missing information or to correct any information. Block 24c (Foreign Service) enter total active duty outside continental limits of the United States for the period covered by the DD Form 214 and the last oversea theater in which service was performed, e.g., "Foreign and/ or Sea Service (USAREUR)." BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was warranted. The applicant’s contentions were carefully considered. The Board agreed his DD Form 214 already shows that he was assigned to U.S. Army Vietnam, and granted Foreign Service credit under U.S. Army Pacific. However, for clarification to external agencies, the Board agreed to specifically show his Vietnam service within the Remarks portion of his DD Form 214.
