Army Regulation 635-5 (Separation Documents), in effect at the time, governed the preparation of the DD Form 214. It stated the DD Form 214 would be prepared for all personnel at the time of their retirement, discharge, or release from active duty. The regulation stated item 3 would list the SSN verified in the Soldier's records. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found the evidence supports the requested relief. 2. The applicant's record shows he consistently used the SSN shown on his social security card. The evidence supports a conclusion that a typographical error occurred in recording his SSN on his DD Form 214 for the period ending 20 August 1972. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by replacing the entry recorded in item 3 of his DD Form 214 for the period ending 20 August 1972 with the SSN shown on his social security card. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
