The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states her DD Form 214 does not reflect details of her complete service obligation and it is missing information. She reclassed and was discharged as a 42A with the rank of SPC. 3. The applicant provides: a. Her driver’s license to prove her identity since her last name has changed. Her maiden name was Charles. b. Orders D-04-205301 dated 3 April 2012, noted the applicant was honorably discharged from the USAR with an effective date of 3 April 2012. 4. A review of the applicant’s service record shows: a. She enlisted in the U.S. Army Reserve on 2 April 2004. b. She entered active duty on 13 July 2004 to complete her Automated Logistical Specialist training for 12 weeks. c. On 15 December 2004, she was honorably released from active duty. Her DD Form 214 shows she completed 5 months and 3 days of total active service. It also shows in Block 23 (Type of Separation) she was released from active duty training. d. Orders 08-269-00015, dated 25 September 2008, indicated her rank as specialist/E-4 and her MOS changed as follows: * Awarded: PMOS 42A1O00OO SMOS: 92AO00O * Withdrawn: PMOS 92A1O00OO e. Orders D-04-205301 dated 3 April 2012, noted the applicant was honorably discharged from the USAR in the grade of specialist/E-4 with an effective date of 3 April 2012. 5. By regulation, the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the requested relief was not warranted. The applicant’s contentions were carefully considered. The applicant enlisted for eight years in the USAR on 2 April 2004. Her service obligation would end 1 April 2012. Her DD Form 214 correctly shows this service obligation date. Her MOS change and promotion to SPC both occurred after the period covered by the DD Form 214. Therefore, the Board agreed there was no error or injustice with her MOS and rank as shown on the form. However, prior to closing the case, the Board did note that the applicant’s DD Form 214 for the period ending 15 December 2004 shows she was ordered to active duty for training as a USAR Soldier. She completed 5 months and 3 days of training and was awarded a military occupational specialty; however, her character of service shows uncharacterized. The Board agreed the character of service should reflect Honorable. The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. 2. However, prior to closing the case, based upon a recent change in policy, the Board identified a required administrative correction to the applicant’s record. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by reissuing her a DD Form 214 for the period ending 15 December 2004 showing the character of service as Honorable. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice.
