The applicant did not file within the 3 year time frame provided in Title 10, U.S. Code, section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: * she had a delayed entry bonus for $6500 * she was never paid her bonus * she filled out the correct documents at her first duty assignment * she was told it could take a few years to be paid * she never received the bonus 3. The applicant provides a portion of her bonus addendum and enlistment contract. The total amount of her bonus was for $6500. 4. The applicant's bonus addendum is in her maiden name. She was married on 22 May 2012. She was honorably released from Active Duty on 5 December 2014. 5. In the processing of this case an advisory opinion was obtained from the Office of the Deputy Chief of Staff, G-1 on 31 May 2018. The Chief, Accessions Division recommended approval of the applicant's request. A copy of the complete advisory opinion has been provided to the Board for their review and consideration. 6. The applicant was provided a copy of this advisory opinion on 29 June 2018 to provide her an opportunity to comment and/or submit a rebuttal. She did not respond. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined that relief was warranted. Based upon the G1 advisory opinion recommendation, the Board concluded that granting the payment of the applicant’s enlistment bonus was appropriate. For that reason, the Board recommended granting the applicant’s request for relief. REFERENCE: Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.
