ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 22 August 2019 DOCKET NUMBER: AR20170013774 APPLICANT REQUESTS: correction to his rank on his DD Form 214 (Certificate of Release or Discharge from Active Duty) from “CPL” to “SGT.” APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * 3rd Armored Brigade Combat Team Orders 113-008 * DD Form 214 FACTS: 1. The applicant states, in effect, he was on Rear Detachment while his company was deployed to Germany. No one had access to promote him in the system. 2. The applicant provides a copy of Headquarters, 3rd Armored Brigade Combat Team, orders 113-008, dated 23 March 2017, which reflects he was promoted to the rank of Sergeant, with an effective date of 1 April 2017. 3. A review of the applicant’s service record shows: a. He enlisted in the Regular Army on 3 May 2011. b. DA Form 638 (Recommendation for Award) dated, 23 March 2017, reflects he was recommended for an Army Achievement Medal (AAM) as his expiration term of service (ETS) award, with the proposed presentation date of 28 April 2017. The form reflects his rank as Corporal (CPL). c. He was released from active duty and transferred to the United States Army Reserve (USAR) on 25 June 2017, under the provisions of AR 635-200, Chapter 4, completion of required active service, and his service was characterized as honorable. It also shows his rank as CPL/E-4. 4. Army Regulation 600-8-19 (Enlisted Promotions and Reductions) prescribes the enlisted promotions and reductions function of the military personnel system. It is linked to the AR 600–8 series and provides principles of support, standards of service, policies, tasks, rules, and steps governing all work required in the field to support promotions and reductions. It provides the objectives of the Army’s Enlisted Promotions System, which include filling authorized enlisted spaces with the best qualified Soldiers. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was warranted. Based upon Order #113-008, dated 23 March 2017, showing the applicant was promoted to Sergeant/E5 with an effective date of 1 April 2017, and the DD Form 214 of the applicant covering that period of time, as well as a lack of evidence to show the applicant was reduced after that promotion, the Board concluded there was sufficient evidence to show an error in the rank reflected on the applicant’s DD Form 214. AR 635-5 (Separation Documents) in effect at the time prescribes the separation documents that will be furnished each individual who is separated from the Army.
