APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DA Form 2-1 (Personnel Qualification Record – Part II) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), and section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states she was stationed at Headquarters, and Headquarters Detachment, Camp Casey, Korea and the overseas duty need to be identified for different organizations and benefits. 3. The applicant’s service record shows: a. Having prior service in the Army Reserve Delayed Entry/Enlistment Program, she enlisted in the Regular Army on 24 August 1984. b. Her DA Form 21 shows in: * Section I – Identification Data, item 5 (Oversea Service): from 26 December 1984 to 18 December 1985, Korea * Section II – Classification and Assignment Data, item 9 (Awards, Decorations & Campaigns) one overseas ribbon * Section II does not reflect the award of the Korea Defense Service Medal (KDSM), as authorized as per AR 600-8-22 (Military Awards) * Section VII – Current and Previous assignments – shows effective 3 January 1985, she was assigned to Headquarters and Headquarters Company 2nd Infantry Division, Korea c. Her DD Form 214 shows she was honorably released from active duty on 23 June 1987, under the provisions of Army Regulation (AR) 635-200 (Enlisted Personnel – Personnel Separations), paragraph 16-8, reduction in authorized strength. It also shows she was awarded or authorized: * Army Service Ribbon * Overseas Service Ribbon * Marksmanship Marksman Badge (Rifle) * Army Lapel Button 4. By regulation, AR 600-8-22 (Personnel Separations Separation Documents) states the Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who have served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. 5. By regulation, AR 635-5 (Personnel Separations Separation Documents) states when preparing block 12f of the DD Form 214, to enter the total amount of foreign service completed during the period covered in block 12c (net active service this period).. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found the relief was not warranted. The applicant’s contentions, evidence provided, and military record was carefully considered. The Board agreed her foreign service is already accurately shown on her separation document. Her service in Korea was not a combat deployment in which an annotations in the remarks would have been required by regulatory guidance. Therefore, there is insufficient evidence to grant relief. 2. Prior to closing the case, the Board did note the analyst of record administrative notes below, and recommended the correction is completed to more accurately depict the military service of the applicant. ADMINISTRATIVE NOTE(S): A review of the applicant’s records shows her DD Form 214 omitted administrative entries in the block 13 – Decoration, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized. As a result, amend the DD Form 214 by adding in block 13 the entry “Korea Defense Service Medal”. REFERENCES: 1. AR 600-8-22 (Military Awards) states the Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who have served on active duty in support of the defense of the Republic of Korea. The area of eligibility (1) encompasses all land area of the Republic of Korea and the contiguous water out to 12 nautical miles and (2) all air spaces above the land and water area. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. Service members must have been assigned, attached, or mobilized to units operating in the area of eligibility for 30 consecutive or for 60 nonconsecutive days or meet several criteria including: (1) be engaged in combat during an armed engagement, regardless of the time in the area of eligibility or (2) be wounded or injured in the line of duty and required medical evacuation from the area of eligibility. 2. AR 635-5 (Separation Documents) at the time established the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of their military service. Chapter 2 of the regulation in effect at the time contains guidance on the preparation of the DD Form 214. It states when preparing block 12f of the DD Form 214, to enter the total amount of foreign service completed during the period covered in block 12c (net active service this period). Obtain the foreign service listed in Sec 1, DA Form 4037 (ORB) for officers or Item 5, DA Form 2-1 for enlisted Soldiers to compute this entry.
