ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 29 October 2019 DOCKET NUMBER: AR20170014469 APPLICANT REQUESTS: In effect, to correct DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), item 17 (Current Active Service Other Than by Induction block b (Term of Service (Years)) and block c (Date of Entry). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214, effective date 12 April 1968 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he needs information for DD Form 214, boxes 17b and 17c. 3. A review of the applicant’s service record shows: a. On 13 April 1966, he was inducted in the Army of the United States. b. DA Form 20 (Enlisted Qualification Record) shows he served in Vietnam from 12 September 1966 to 3 September 1967. c. On 12 April 1968, he was honorably released from active duty under the provisions of AR 635-200 (Personnel Separations – Enlisted Personnel), chapter 2 (Expiration of Term of Service), and issued an honorable discharge. His DD Form 214 reflects he completed 2 years of active service. Block 17 (Current Active Service Other Than by Induction) block b (Term of Service (Years)) and block c (Date of Entry) show NA. 4. By regulation, DD Form 214 will be prepared for all personnel at the time of their retirement, discharge, or release from Active Army. Block 17b should indicate the term of service in years for which enlisted, reenlisted, or ordered to active duty. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. Block 17b on the DD Form 214 reflects the number served in years for which a Soldier enlisted, reenlisted, or was ordered to active duty. The Board wished to inform the applicant that inducted means drafted while enlisted means he voluntarily signed up for a certain term of service. The Board found that the evidence showed the applicant was inducted into the Army; he did not enlist. Therefore, the information currently in block 17b is correct. Additionally, the Board members found his DD Form 214 already reflects the date of induction of April 1966. For the above reasons, the Board concluded there was no evidence of an error or injustice which would warrant making a change to the applicant’s military record. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Personnel Separation – Separation Documents), in effect at the time, states DD Form 214 (Certificate of Release or Discharge from Active Duty) will be prepared for all personnel at the time of their retirement, discharge, or release from Active Army. a. Paragraph 40 (Item 17b) directs this block should indicate the term of service in years for which enlisted, reenlisted, or ordered to active duty. For active duty for training (ACDUTRA) personnel, enter “NA.” b. Paragraph 41 (Item 17c) directs to enter the date entered on active duty or date enlistment or reenlistment was accomplished.
