APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he believes he earned the badge but it is not listed on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). 3. The applicant enlisted in the Regular Army and awarded military occupation specialty (MOS) 11B (Light Weapons Infantryman). 4. His record shows he served in the Republic of Vietnam from 4 November 1970 to 15 October 1971, he was assigned: * 4 November 1970 – 11 December 1970, HHC, 3rd Battalion, 506th Infantry * 12 December 1970 – 3 May 1971, Company B, 3rd Battalion, 506th Infantry * 4 May 1971 – 15 October 1971, Company C, 3rd Battalion, 187th Infantry 5. His records provides copies of general orders showing he was awarded the Air Medal while assigned to Company B, 3rd Battalion, 506th Infantry for meritorious achievement while participating in aerial flight and the Bronze Star Medal for meritorious service while assigned to Company C, 3rd Battalion, 187th Infantry. 6. Neither the applicant nor his records provide evidence that shows he participated in ground combat. 7. Army Regulation 600-8-22 (Military Awards) states the CIB is awarded to infantry officers and to enlisted and warrant officer. They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size. BOARD DISCUSSION: The Board considered the applicant’s request with all supporting documents, service records, applicable regulations, policy, and guidance. The record shows that the applicant served as an infantryman in the Republic of Vietnam from 4 November 1970 to 15 October 1971, however there is no evidence that he participated in active ground combat.
