The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the Basic leader course, his promotion to E5 and his GWOT-EM are not reflected on his DD Form 214. 3. The applicant provides: a. A memorandum for record, dated 20 January 2016, issued by Headquarters, 3rd Battalion, 29th Field Artillery. The memorandum shows the applicant’s statement of service for the GWOTEM for his service in Operations Enduring Freedom and Inherent Resolve, during the period 22 February 2015 to 20 September 2015. b. A copy of orders 17-151-00032, dated 31 May 2017, issued by Headquarters, 63D Regional Support Command, Mountain View CA. The order promotes the applicant from E4 to E5 with an effective date of 1 June 2017. c. A copy of a certificate of completion showing he successful completed the Basic Leader Course, dated 3 February 2017. d. A copy of DA Form 1059, (Service School Academic Evaluation Report), dated 2 February 2017, documenting the applicant achieved course standards for the Basic Leader Course, Class 17-002. 4. A review of the applicant’s service record shows: a. He enlisted in the Regular Army on 17 October 2012. b. He served in Afghanistan from 22 February 2015 to 20 September 2015. c. On 19 December 2015, he was honorably released from active duty. His DD Form 214 shows he completed 3 years, 2 months and 3 days of active service. It also shows he was authorized or awarded the: * Army Commendation Medal * Army Achievement Medal (2nd Award) * Army Good Conduct Medal * National Defense Medal * Global War on Terrorism Service Medal * Army Service Ribbon * Armed Forces Reserve Medal w/M Device * Driver and Mechanic Badge –Mechanic * Certificate of Achievement d. The applicant successfully completed the Basic Leader Course on 3 February 2017 and was promoted to E5 effective 1 June 2017, both actions occurred after the date of his current DD Form 214. 5. By Regulation, 635-5, (Separation Documents), the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions, as they existed at the time of separation: * Item 4 (Grade, Rate of Rank) – Enter active duty grade or rank and pay grade at time of separation from Enlisted Record Brief (ERB) or Officer Record Brief (ORB). * Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) - List awards and decorations for all periods of service in the priority sequence specified in AR 600-8-22. Each entry will be verified by the soldier's records, do not use abbreviations. * Item 14 (Military Education), from ERB/ORB, list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214.' BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. The applicant’s contentions were carefully considered. Although the certifying official on the Statement of Service noted he was authorized several awards and decorations in support of name operations, the information provided does not confirm his deployment to a country. The country in which the Foreign Service was completed is needed for addition to the DD Form 214. In addition, the applicant would be authorized the Afghanistan Campaign Medal in lieu of the GWOTEM if he deployed in support of OEF during the period covered by the form. The Board found that the applicant’s course completion and promotion was completed after the period covered by the DD Form 214. The Board agreed records must reflect the conditions and circumstances that existed at the time the records were created. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
