The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his dad was career Air Force. Texas is his home, his grandparents and ex-wife lived in West Virginia (WV). His home of record is Texas. He received his education in TX (1986-Brookhaven College, Farmers Branch, TX); (1990- Texas Woman’s University – Dallas, TX); (1997-Texas Wesleyan University – Fort Worth, TX). Having a WV home of record (HOR) negatively impacts Texas Veterans’ benefits. He has lived in TX since date of discharge. The error is negatively impacting him as an honorably discharged veteran in receiving Texas education benefits. 3. The applicant provides college transcripts from Texas Woman’s and Texas Wesleyan Universities as proof of his residency after expired term of service (ETS). 4. The applicant’s service records shows: a. The applicant enlisted in the Regular Army on 29 June 1983. b. On his DD Form 4 (Enlistment / Reenlistment Document – Armed Forces of the United States): * Block 5 (Home of Record) – Omar, WV 25638 * Block 6 (Place of Enlistment) – Military Entrance Processing Station, Beckley, WV c. On his DD Form 1966/2 and 1966/3 (Record of Military Processing – Armed Forces of the United States): * Block 22 (Education) – X___High School, Logan, WV, September 1980 to Present * Block 23 (Citizenship/Place of Birth) – X___, NC – Wayne County * Block 27 (Employment) – Burger Chef and Silver Brand, Logan, WV from June 1982 to Present * Block 28 (Residences) – #### B, X___ X___ , Homestead, FL from August 1977 to July 1979 * Block 28 (Residences) – Box ###, X___, WV from July 1979 to Present d. His Home of Record/Address as Omar, WV in Item 25 (Home of Record/Address) of Section IV (Personal and Family Data), on his DA Form 2-1 (Personnel Qualification Record – Part II). e. Orders 62-55, dated 26 March 1986 lists his HOR as Omar, WV and his Place of Entry on Active Duty as X___, WV. f. His DD Form 214 shows he was honorably transferred to the U.S. Army Reserves on 28 April 1986. He completed 2 years and 10 months of active service. It also shows in Item 21 (Signature of Member Being Separated), he authenticated this document by hand signature. g. Entries on his DD Form 214 and DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty are consistent with information the applicant provided upon enlistment in the Regular Army. 5. By regulation (Army Regulation (AR) 635-5 (Personnel Separations – Separation Documents)) prescribes the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparing and distributing DD Form 214 for: * Item 6 (Place of Entry into Active Duty), enter the city and state from which member last entered on active duty from civilian life * Item 19 (Mailing Address After Separation), enter the mailing address and county of residence furnished by the individual at time of separation * Item 20 (Member Requests Copy 6 Be Sent To), insert state requested by the member and place an “X” in the proper block 6. AR 600-8-104 states the term “home of record” means the place (city and state or country) recorded as the home of the individual when commissioned, appointed, reappointed, enlisted, reenlisted, inducted, or ordered to a tour of active duty. Home of Record/Address are no longer required to be posted for the Active Army. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was not warranted. Based upon the documentary evidence provided by the applicant, found within the service record, and the facts and circumstances of the applicant’s separation, the Board concluded that all information currently reflected is accurate and correct. The separation document has no errors and there is insufficient evidence to show that a change is warranted.
