ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 15 April 2019 DOCKET NUMBER: AR20170015246 APPLICANT REQUESTS: Reconsideration of his earlier request to correct his military occupational skill (MOS) and add his Korean Defense Service Medal. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he previously requested that his MOS be updated to show 62B20. 3. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20150014828 on 15 December 2016. 4. With respect to the applicant's MOS as recorded on his DD Form 214, the applicant's record contains evidence that he held the primary MOS 62E at the time of his separation from military service. His "Certificates of Proficiency" do not award him an MOS but show he completed a course of instruction in a subject area. He may have been awarded these specialties by proper authority; however, an entry on his DA Form 20 suggests any such earlier award was replaced by a later award of MOS 62E as his primary MOS. 5. The applicant's enlisted qualification record shows he served in Korea for 2 years, 3 months and 6 days from 9 June 1965 to 24 September 1967. His DD Form 214 does not show award of the KDSM. 6. He provides two copies of the Department of the Army Certificate of Training. One for successfully completing the Army Equipment Records System TAERS and the USARPAC Standard supply course however was not awarded the MOS 92Y. He also provides two United States Army Engineer School Certificates of Proficiency for completion of the Engineer Equipment Maintenance Course and the Engineer Equipment Repair Course. BOARD DISCUSSION: After review of the application and all evidence, the Board determined relief is warranted. The applicant’s contentions were carefully considered. He served in the Republic of Korea during a period in which the KDSM was authorized; however, it is not shown on his DD Form 214. His record show he completed training in MOSs 62B and 62E. His record shows he was awarded 62E as his primary MOS on 23 February 1967, and there is no record of a primary MOS change to 62B before his separation on 27 September 1967. The applicant’s record shows he served in MOS 62B positions. Regulatory guidance shows the PMOS at the time of his separation would be listed on the DD Form 214. Based on regulatory guidance, the Board agreed there was no error or injustice with the listing of his MOS on the separation document. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the KDSM to his DD Form 214. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to correction of MOS. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who have served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. 3. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. a. The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. b.
