The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, he is requesting a correction to his DD Form 214 to show Iraq deployment from January 2004 to February 2005. 3. The applicant provides: * Letter from Ramsey County Veterans Services requesting a correction to his DD Form 214 to show Iraq Service * DD Form 214 period ending 31 May 2005 reflecting no deployment in block 18 4. The applicant’s record shows: a. He enlisted in the Regular Army on 18 May 2001. b. His Enlisted Records Brief dated 7 February 2005 shows in section 1 (Assignment Information/ Overseas Deployment Combat Duty) shows no combat deployment period of service. c. On 11 August 2019 an email from Ms. D.B. from Defense Finance and Accounting Service to Ms. W.J. states the applicant’s foreign service in Kuwait was from 1 February 2004 to 28 February 2005. d. He was discharged from active duty on 31 May 2005. His DD Form 214 shows that he was discharged with an honorable character of service. He completed 4 years, and 13 days of active service. Block 12f (Foreign Service) shows 3 years 6 months and 18 days of Foreign Service. Block 18 does not reflect period of deployment to Kuwait. 5. By regulation (AR 635-8 (Separation Processing and Documents)), item 12f (Foreign Service) of the DD Form 214 lists all foreign service performed outside continental United States. Only when active duty Soldiers are deployed with their unit during their continuous period of active service. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. The applicant’s contentions were carefully considered. Evidence of record shows he was assigned to Kuwait for approximately one year. However, the record does not confirm he entered into Iraq. Based upon a review of the documentary evidence provided by the applicant and found within the military service record, the Board found no information in the form of any award, deployment order etc. that shows he entered into Iraq. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) established the standardized policy for preparing and distributing the DD Form 214. Chapter 2 contains guidance on the preparation of the DD Form 214.
