The applicant did not file within the 3-year time frame as provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states award of the Valorous Unit Award was omitted from his DD Form 214 at the time of his discharge from the Army. 3. Item 5 (Oversea Service) of his Personnel Qualification Record – Part II shows he received credit for oversea service in Saudi Arabia from 25 December 1990 through 30 April 1991. 4. On 16 April 1991, he was awarded the Army Commendation Medal for meritorious achievement during the period 17 January to 2 March 1991 while assigned to 6th Battalion, 6th Infantry Regiment, in Iraq.? 5. He was honorably discharged on 11 July 1992. His DD Form 214 shows he was awarded or authorized the: * Army Service Ribbon * National Defense Service Medal * Army Lapel Button * Army Good Conduct Medal * Kuwait Liberation Medal * Southwest Asia Service Medal with three bronze service stars * Overseas Service Ribbon with Numeral 1 * Expert Infantryman Badge * Combat Infantryman Badge * Expert Marksmanship Qualification Badge with Rifle Bar (M-16) * Expert Marksmanship Qualification Badge with Mortar Bar (81 millimeter) * Marksman Marksmanship Qualification Badge with Grenade Bar * Army Commendation Medal 6. Department of Army General Orders Number 12, dated 23 May 1994, awarded the Valorous Unit Award to 6th Battalion, 6th Infantry Regiment, for extraordinary heroism during the period 26 to 28 February 1991. BOARD DISCUSSION: After reviewing the application and all supporting evidence, the Board found that relief was warranted. Based upon information found in the military record, evidence was present to support full relief. ADMINISTRATIVE NOTES: The applicant was awarded an unspecified Kuwait Liberation Medal. He met the eligibility criteria for both the Kuwait Liberation Medal- Saudi Arabia and Kuwait Liberation Medal-Kuwait under the provisions of Army Regulation 600-8-22 (Military Awards). BOARD DETERMINATION/RECOMMENDATION: The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 as follows: * deleting award of the Kuwait Liberation Medal * adding the following awards: * Kuwait Liberation Medal – Kuwait * Kuwait Liberation Medal – Saudi Arabia * Valorous Unit Award I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. ? REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards), prescribes Department of the Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Kuwait Liberation Medal awarded by the Government of Saudi Arabia was approved on 3 January 1992 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 17 January 1991 and 28 February 1991. b. The Kuwait Liberation Medal awarded by the Government of Kuwait was approved on 9 November 1995 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 2 August 1990 and 31 August 1993.
