FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he needs his DD Form 214 to show all combat information for Desert Shield/Desert Storm. He did not have a combat military occupational skill but was attached to the 4th Battalion, 3rd Field Artillery, 3rd Brigade of the 1st Infantry Division. The Veterans Affairs stated he did not have any combat information on his DD Form 214 and needed it corrected. The listed campaign awards on his DD Form 214 were not good enough to support his post-traumatic stress disorder (PTSD) claim. He also stated he would like copies of award records and any medals awarded. 3. The applicant’s records shows: a. He enlisted in the Regular Army on 18 April 1987. b. He served in Germany from 27 April 1989 to 15 August 1991 with B Company, 498th Support Battalion, 2nd Armored Division (Forward). He received normal tour credit. c. He deployed in a temporary duty status to Southwest Asia (SWA) in support of (ISO) Operations Desert Shield and Desert Storm on 5 January 1991. d. The National Personnel Records Center database inquiry shows the applicant served in SWA, ISO of Operations Desert Shield and Desert Storm from 5 January 1991 to 14 May 1991. e. Department of the Army General Order 27, dated 27 December 1994 awarded the 498th Support Battalion the Meritorious Unit Commendation. f. The applicant’s DD Form 214 shows he was honorably released from active duty on 19 August 1991. He completed 4 years, 0 months, and 2 days of active service. in: (1) Block 12f (Record of Service – Foreign Service) cumulative of his normal tour in Germany and his temporary duty in SWA, ISO of Operations Desert Shield and Desert Storm. (2) Block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) he was awarded the Southwest Asia Service Medal with 2 bronze stars for his SWA service ISO of Operations Desert Shield and Desert Storm. * Army Service Ribbon * Overseas Service Ribbon * Southwest Asia Service Medal with 2 bronze stars * National Defense Service Medal * Army Good Conduct Medal * Marksman Marksmanship Qualification Badge with Rifle Bar (M-16) * Expert Marksmanship Qualification Badge with Grenade Bar (3) Block 18 (Remarks) shows an entry of “Service in SWA 5 Jan 1991 to 15 May 1991,” which further supports he served ISO of Operations Desert Shield and Desert Storm. 4. By regulation, in effect at the time, the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was warranted. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board found the foreign service is already listed but the awards are missing (KLM (Kuwait) and KLM (Saudi Arabia). Additionally, Board members voted to clarify SWA to read Southwest Asia. The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 19 August 1991 by: * adding to block 13 the Kuwait Liberation Medal – (Kingdom of Saudi Arabia) and the Kuwait Liberation Medal – (Government of Kuwait) * deleting from Block 18 the entry Service in SWA 5 Jan 1991 to 15 May 1991 and adding the entry Service in Southwest Asia 5 January 1991 to 15 May 1991 2. The Board also noted the administrative note below from the analyst of record and recommended that change also be completed to more accurately reflect the military service of the applicant. ADMINISTRATIVE NOTE(S): A review of the applicant’s records shows he is authorized awards and decorations not annotated on his DD Form 214. As a result, correct his DD Form 214 by adding the Meritorious Unit Commendation REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) in effect at the time, states the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge.
