The applicant did not file within the three year time frame provided in Title 10, U.S. Code, section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he was designated with the specialty of tank driver on 11 August 1962. He was denied a Department of Veterans Affairs benefit because of this error. 3. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20150017979 on 27 April 2017. 4. The applicant was a member of the (ALARNG) from 17 July 1961 to 16 July 1967. His service record and DD Form 214 shows he held military occupational specialty (MOS) 131.00 (Security Guard). 5. A letter from the State Military Department states after researching archived files it was found that the applicant is correct. He was given a Security Guard MOS, but only for the period of the Berlin Crisis. Everyone who participated in this military action did so under Security Guard MOS. After the Berlin Crisis was over, the 131.20 (MOS) was withdrawn. Special Order Number 27, 8 September 1965 withdrew the 131.20 (MOS) and awarded back the applicant’s (MOS) P11E20 (Tank Gunner). 6. Army Regulations 635-5 (Separation Documents), established standardized policy for preparation of the DD Form 214. The instructions for item 25a stated to enter the primary MOS code number and title. BOARD DISCUSSION: After reviewing the application and all supporting evidence, the Board determined that partial relief was warranted. Based upon the letter from the State Military Department stating the applicant was correct and that the applicant’s MOS should be reflected as a Tank Gunner, P11E20, the Board recommends changing the MOS on his DD214 to reflect such. However, the Board also found that the portion of the applicant’s request relating to reflecting the MOS as Tank Driver should not be granted. The Board found that being a Tank Driver is a task within the MOS of Tank Gunner and is not a separate MOS to be reflected on a DD214. The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 25a of his DD Form 214 to show primary military occupational specialty "PLLE2O, Tank Gunner." 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to changing his military occupational specialty to “Tank Driver.” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulations 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. The instructions for item 25a stated to enter the primary MOS code number and title.
