The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant enlisted in the Regular Army on November . 3. All records available in her official military personnel file list her SSN as "XXX-XX- XXXX" and her last name as "XXXXX." 4. The applicant was released from active duty on 23 June 2013. Her DD Form 214 lists her SSN as "XXX-XX-XXXX" and her last name as "XXXXX." 5. The applicant provides a copy of her Report of Confidential Social Security Benefit Information that lists her SSN as "XXX-XX-XXXX" and a Final Decree Changing the Name of an Adult dated 4 September 2013, which changed her last name from "XXXXXX" to "XXXXX." 6. The DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. BOARD DISCUSSION: 1. After review of the application and all evidence, the Board determined relief was not warranted. The applicant’s contentions were carefully considered. She used the contested SSN and contested name during her entire period of service. The applicant provided evidence that shows the SSN and last name was changed after her period of service. There were no extenuating circumstances (for example, witness protection) provided for the Board to consider. Regulatory guidance provides for the showing of circumstances as they were at the time the separation document was completed. 2. The applicant is advised that a copy of this decisional document will be filed in her official military personnel file. This should serve to clarify any questions or confusion about the difference in the name and SSN recorded in her military records and the name and SSN on her SSN Card and court document.
