ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS BOARD DATE: 12 March 2019 DOCKET NUMBER: AR20170017034 APPLICANT REQUESTS: correction to item 11 (Primary Specialty) of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show her military occupational specialty as 92Y (Unit Supply Specialist) instead of 92M (Mortuary Affairs Specialist). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, the MOS on her DD Form 214 is incorrect. 3. A DD Form 1966 (Record of Military Processing – Armed Forces of the United States) and documentation attached to her enlistment contract, dated 31 July 2003, shows the applicant enlisted to serve in and attend a training school for MOS 92Y. 4. She enlisted in the Regular Army on 15 January 2004. 5. The applicant’s enlisted record brief (ERB) shows she was assigned Company P, 266th Quartermaster Battalion for advanced individual training on 29 March 2004 and she reported to her first duty station in Germany on 27 June 2004. a. The Military Education portion of her does not list any Mortuary Affairs courses or training but does show she completed the following courses: * Unit and Organizational Supply Course – 2004 * Small Arms Maintenance – 2004 * Nuclear Biological Chemical (NBC) Defense Course – 2004 * Property Book * Unit Supply Enhancement - 2007 b. The assignment information section of her ERB shows she consistently served as an armorer or a supply specialist/sergeant in MOS 92Y from the time she arrived at her first duty station on 27 June 2004 until 17 November 2011. c. There are only two entry showing her MOS as 92M: * the ERB, dated 5 December 2011 lists her primary MOS (PMOS) as 92M * the assignment section, dated from 18 November 2011, lists her duty title as surplus Soldier and her duty MOS (DMOS) as 92M 6. The following documents in the applicant's record show her MOS as 92Y: * DA Form 1059 (Service School Academic Evaluation), dated 3 August 2007 * Two Noncommissioned Officer Evaluation Reports covering the full period from 1 August 2009 through 1 December 2010 * Three DA Forms 4187 (Personnel Action), dated 18 August 2011, 20 August 2011, and 16 March 2012 7. Her record does not contain any orders awarding her the PMOS of 92M. 8. She was discharged on 18 April 2012. Her DD Form 214 contains the following entries: a. item 11, "92M1O MORTUARY AFFAIRS SPEC – 7YRS 11MOS// NOTHING FOLLOWS b. item 14 (Military Education) shows she attended the following courses/schools: * "MORTUARY AFFAIRS SPEC, 5 WEEKS, 2004" * "NBC DEFENSE CRS, 2 WEEKS, 2004" * "SMALL ARMS MAINT, 2 WEEKS, 2004" * "UNIT & ORGNL SUP CRS, 1 WEEK, 2004" * "PROP BOOK UT SPLY ENH, 1 WEEK 2007" 9. Army Regulation 635-5 (Separation Documents) the following directions for completing the DD Form 214: a. The guidance for completing item 11 (Primary Specialty) states, from the ERB, enter the titles of all MOS served for at least 1 year and include for each MOS the number of years and months served. For time determination, 16 days or more count as a month. Do not count basic training and AIT. b. The guidance for completing item 14 (Military Educations) states, from ERB list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. Include title, length in weeks, and year completed. BOARD DISCUSSION: After review of the application and all evidence, the Board determined there is sufficient evidence to grant relief. The applicant’s contentions and military record were carefully considered. There are numerous official documents within the applicant’s record that shows she was a 92Y and evaluated as a 92Y. In addition, she was not available to authenticate the validity of her DD Form 214. The Board agreed the applicant’s record should show 92Y as the PMOS. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 11 of her DD Form 214 for the period ending 18 May 2012 by deleting “92M1O MORTUARY AFFAIRS SPEC I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. ADMINISTRATIVE NOTE(S): Not Applicable REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214 (Certificate of Release or Discharge from Active Duty). Paragraph 2-4 (Completing the DD Form 214) states: a. The guidance for completing item 11 (Primary Specialty) states, from the ERB, enter the titles of all MOS served for at least 1 year and include for each MOS the number of years and months served.
