ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 22 August 2019 DOCKET NUMBER: AR20170017296 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to reflect his continuous honorable service. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Orders 238-0222 dated 26 August 2014 * Statement of Service dated 5 May 2017 * Orders 191-1320 dated 10 July 2017 * DD Form 214 FACTS: 1. The applicant states Block 18 of his DD Form 214 should reflect that he completed his first full term which he should have received an honorable discharge for. The evidence he has submitted supports his claim that he completed his first full term. He transitioned from the Army after completion of his initial contract and there is no extension paperwork that shows he was held past his expiration of term of service (ETS). 2. The applicant provides: a. Orders 238-0222, dated 26 August 2014, which stated he was released from active duty and assigned to the U.S. Army Reserve Control Group with an effective date of 18 December 2014, unless changed or rescinded. His terminal date of Reserve obligation ended on 13 October 2018. b. A Statement of Service, dated 5 May 2017, noted the following periods of service: * Active Army from 25 July 2011 to 29 December 2014 * Absent without leave (AWOL) from 30 December 2014 to 8 January 2015 * Confined from 9 January 2015 to Present (date of memorandum) * c. Orders 191-1320, dated 10 July 2017, noted he was discharged from the Regular Army with a 12 July 2017 effective date. d. Member copies 1 and 4 of his DD Form 214. 3. A review of the applicant’s service record shows: a. He enlisted in the Army Reserve on 14 October 2010. His DD Form 4 (Enlistment/Reenlistment Document) shows he was to serve 3 years and 21 weeks on Active Duty and 4 years and 31 weeks in the Reserve Component. He entered active duty on 25 July 2011. b. A DA Form 638 (Report to Suspend Favorable Personnel Action), dated 23 January 2015, indicated he was flagged for adverse action. c. On 18 March 2015, he was convicted by a general court-martial for specification of being AWOL from 30 December 2015 to 13 January 2015 and one specification of false official statement under oath. His sentence included confinement for four months and a bad conduct discharge. d. On 17 July 2015, the convening authority approved the sentence and except for that part of the sentence extending to a bad conduct discharge, ordered the sentence executed. e. General Court-Martial Oder Number 71, dated 5 May 2017, after Article 71(c) was complied with and the sentence was affirmed, ordered the dishonorable discharge executed. f. On 12 July 2017, he was discharged from active duty with a dishonorable discharge characterization of service. His DD Form 214 (Certificate of Release or Discharge from Active Duty) shows he completed 3 years, 5 months, and 5 days of active service with 14 days of lost time. It also shows a period of delayed entry from 14 October 2010 to 24 July 2011 and that the applicant did not completed his full term of service. No awards or badges were authorized. 4. By regulation, a. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. a. b. Soldiers who have previously reenlisted without being issued a DD Form 214 and are separated with any characterization of service except "Honorable", enter "Continuous Honorable Active Service from" (first day of service for which DD Form 214 was not issued) until (date before commencement of current enlistment). BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was not warranted. Based upon the reason for separation prior to the applicant completing his first term of service, as evidenced by the current statement depicted on his DD Form 214, the Board found no evidence that the applicant completed a term of honorable service which would warrant making a change to his military service record. BOARD VOTE: Mbr 1 Mbr 2 Mbr 3 : : : GRANT FULL RELIEF : : : GRANT PARTIAL RELIEF : : : GRANT FORMAL HEARING X X X DENY APPLICATION BOARD DETERMINATION/RECOMMENDATION: The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. 9/23/2019 X CHAIRPERSON Signed by: I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: Army Regulation (AR) 635-8 (Separations Processing and Documents), currently in effect, provides for the preparation and distribution of the DD Form 214.
