The applicant states he did not receive his MASP for 2016. He has been on active duty without interruption since November 2013. He practices surgery at Walter Reed National Military Medical Center and is licensed in the State of Maryland (MD). He has completed the necessary requirements to receive the MASP for 2017 [sic]. He attached his orders covering this period as well as his ORB and a copy of his current license and medical board certification. The amount due for 2017 [sic] is $15,000.00. 2. A review of the applicant’s service records show the following on: * 21 September 2007 – appointed as a Reserve commissioned officer and executed an oath of office * 1 January 2013 – licensed as a physician in medicine and surgery * 31 December 2011 – certified as a cardiothoracic surgeon * 26 August 2015 – by memorandum, to the Army Medical Department (AMEDD) Special Pay Branch, the applicant requested MASP in the amount of $15,000.00 with a one year commitment to begin on 18 November 2015 * his record is void of a MASP request for 2016 3. The applicant provides: * his ORB providing a snapshot of his military career * MD physician license showing he is an authorized unrestricted physician and surgeon with an expiration date of 30 September 2018 * Orders Number 182-03 showing he was assigned to the Uniformed Service University of the Health Sciences * Orders Number 037-05 showing he was reassigned from the Uniformed Services University of the Health Sciences to B Company, Walter Reed National Military Medical Center 4. On 3 December 2018, Office of the Surgeon General reviewed the applicant's records and rendered an advisory opinion in his case. After a thorough review, the Chief, AMEDD Special Pay Branch opined that a review of special pay and finance records indicates no record of a prepared, executed, processed, or paid MASP agreement at $15,000.00/year effective 18 November 2016. The applicant met the eligibility criteria for the entitlement category MASP agreement at $15,000/year effective 18 November 2016. Recommend support. A copy of the complete advisory opinion has been provided to the Board for their review and consideration. 5. The applicant was provided with a copy of this advisory opinion to give him an opportunity to respond and/or submit a rebuttal. He did not respond. 6. Title 37 United States Code (USC), section 302(a)(4) states MASP is paid annually to Medical Corps officers who are not participating in internship or initial residency training. Possession of a current, unrestricted license under the provisions of Army Regulation (AR) 40-68 (Clinical Quality Management) is required. The annual rate regardless of years of creditable service is $15,000.00 per year. BOARD DISCUSSION: The Board carefully considered the applicant’s request, the Office of the Surgeon General (OTSG) advisory opinion, supporting documents, and evidence in the record and found sufficient evidence to grant relief. The Board agreed with the OTSG advisory opinion that the applicant met all the criteria set forth in the Medical Additional Special Pay (MASP) agreement for the year effective 20161118 to 20171117 at $15,000/year. Therefore, the board determined that full relief was warranted. ? As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by 1. showing the applicant was fully authorized the MASP, that the applicant timely executed and submitted his MASP request contract effective 20161118 to 20171117, and that his Personnel Office duly processed his request in a timely manner, and 2. paying him the $15,000 MASP he is due for said period as a result of these corrections I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
