ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 11 March 2019 DOCKET NUMBER: AR20170019631 APPLICANT REQUESTS: in effect, correction of his DD Forms 214 (Certificate of Release or Discharge from Active Duty) for the periods ending 8 July 1986 and 15 November 1988, to show his social security number (SSN) as "XXX-XX-XXXX" instead of "XXX-XX-XXXX." APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 * Letter from the Social Security Administration FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant enlisted in the Regular Army (RA) on 9 September 1983. He was honorably released from active duty on 8 July 1986. The DD Form 214 he was issued lists his SSN as "XXX-XX-XXXX." 3. After a break in service, the applicant enlisted in the RA on 6 November 1986. He was discharged on 15 November 1988. The DD Form 214 he was issued lists his SSN as "XXX-XX-XXXX." 4. The applicant provided a copy of a letter from the Social Security Administration dated 9 February 1990, which shows the applicant was issued a new SSN as "XXX-XX- XXXX." The letter states he was issued a new SSN because the Social Security Administration issued number he previously maintained to another person, in error. 5. Army Regulation 635-5 (Separation Documents), dated 23 May 1972, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It stated to transcribe the SSN at the time of separation from applicable documents in item 3. 6. Army Regulation 635-8 (Separation Processing and Documents), currently in effect, states, that if the Soldier has had more than one social security number, list the other social security number of record in block 18 (Remarks). BOARD DISCUSSION: After review of the application and all evidence, the Board determined there is sufficient evidence to grant relief. The Board agreed the letter from the SSA clearly shows there was an error with the applicant’s issuance of the SSN used during his period of service. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. Item 3 (SSN) states to transcribe SSN at the time of his separation from applicable documents. 3. Army Regulation 635-8 (Separation Processing and Documents), currently in effect, states, for block 3 (Social Security Number (SSN)) Verify accuracy by reviewing initial enlistment contract and/or application for appointment.
