Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal two DA Forms 1059 (Service School Academic Evaluation Report) showing his failure of the Advanced Leader Course (ALC) for class numbers 034-12 (27 June 2012) and class number 004b-15 (27 March 2015). 2. The applicant states he failed the ALC on 27 June 2012 (class 034-12) and 27 March 2015 (class 004b-15) but subsequently passed the course on 18 May 2016 (class 005A-16). 3. The applicant provides no supporting documents. CONSIDERATION OF EVIDENCE: 1. The applicant is currently a Regular Army staff sergeant. 2. The applicant's Official Military Personnel File in the interactive Personnel Electronic Records Management System contains DA Forms 1059 that show: a. on 5 August 2010, he passed the Warrior Leader Course; b. on 27 June 2012, as a sergeant, he was disenrolled from the ALC for failure to achieve the minimum passing score on both the initial examination and retest of AA-02, Man the Force #1; c. on 21 September 2012, he passed the Army Recruiter Course; d. on 27 March 2015, as a sergeant, he was disenrolled from the ALC for failure to achieve the minimum passing score of 70 percent on both the initial examination and retest of TLO 2.0, Deliver Essential Personnel Services; and e. on 18 May 2016, as staff sergeant, he passed the ALC. REFERENCES: 1. Army Regulation 623-3 (Evaluation Reporting System), dated 10 August 2007, prescribed policies and tasks for the Army's Evaluation Reporting System that included reporting systems for officers and noncommissioned officers and academic performance and potential. a. Academic performance counseling and evaluations for military schools will be conducted in accordance with procedures established at the local level by the Commandant of the school and Commander, Training and Doctrine Command. b. The types of reports that will be referred to the student by the reviewing official for acknowledgment and comment include: any report with a "NO" response, any report with an "Unsatisfactory" rating, any report with a "marginally achieved course standards" response, and any report with a "failed to achieve course standards" response. Also, any reports with comments that in the opinion of the reviewing official are so derogatory that the report may have an adverse impact on the student's career will be referred to the student for acknowledgment and comment. c. An evaluation report accepted by HQDA and included in the official record of a rated Soldier is presumed to be administratively correct, to have been prepared by the properly designated rating officials, and to represent the considered opinions and objective judgment of the rating officials at the time of preparation. Removal of an evaluation report for administrative reasons will be allowed only when circumstances preclude the correction of errors, and then only when retention of the evaluation report would clearly result in an injustice to the Soldier. DISCUSSION: 1. The available records show no evidence of errors in the DA Forms 1059 documenting the applicant’s attendance at the ALC in 2012 and 2015 that would serve as a basis for removing the forms from his Official Military Personnel File. The fact that the applicant successfully completed ALC in 2016 is not a basis for removing the DA Forms 1059 documenting his two earlier attempts at completing this course. BOARD DETERMINATION/RECOMMENDATION: The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.
