The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 does not reflect the correct information in the following blocks: * Marksman Marksmanship Badge M-14, Item # 24 (Decorations, Medals, Badges, Commendations, Citation and campaign Ribbons Awarded or Authorized) * 12 years of education, Item# 30 (Remarks) * Wheeled Vehicle Organizational Maintenance Course 3 weeks, Item# 25 (Education and Training) * Apprentice Training Wheeled Vehicle Mechanic, Item# 25. 3. The applicant provides: * Wheeled Vehicle Organizational Maintenance Course Certificate, dated 8 to 25 September 1970 * Certificate of Training for Apprentice Training Wheeled Vehicle Mechanic, dated 16 January 1970 * High School Equivalency Diploma from the United States Armed Forces Institute 4. The applicant’s service records shows: a. He enlisted in the Regular Army on 11 August 1969. He completed basic and advanced individual training at Fort Dix and was awarded the military occupation of Wheeled Vehicle Mechanic (63B). b. His DA Form 20 (Enlisted Qualification Record) shows in item 32 (Civilian Education), the entry “HS GED 1969.” He provides documents showing he received his General Education Diploma (GED) from the Army in February 1970. c. On 2 October 1969, Special Order Number 275 awarded him the Marksman Marksmanship Qualification Badge with M-14 Rifle. d. His DA Form 20 further shows he completed a Mechanic Maintenance Apprentice Course in 1970. e. He served in Germany from 27 July 1970 to 8 March 1972. AEUO Form 61 (Academic Report) shows the applicant completed Wheeled Vehicle Organizational Maintenance Course 8 – 25 September 1970 (2 weeks). f. He was honorably released from active duty in the rank/grade of specialist five/E-5 on 13 March 1972 by reason of physical disability and transferred to the U.S. Army Reserve. g. His DD Form 214 shows he completed 2 years, 6 months, and 26 days of active military service, he had 7 days of lost time. His DD Form 214 also shows in: * item 23a (Specialty Number and Title), 63B2O, 6 April 1970 * item 24, he was awarded or authorized the National Defense Service Medal, Good Conduct Medal, Mechanic Badge, and Expert Marksmanship Qualification Badge with (M-16) Rifle * Item 25, Wheel Vehicle Organization maintenance, 63B2O, 2 weeks, 1970 * Item 30, Civilian Education: 11 Years h. He was issued a DD Form 215 (Correction to DD Form 214) that corrected: * his branch to Engineer * his terminal date of reserve obligation to 25 June 1975 5. Army Regulation 635-5 (Separations Documents), directs to include education completed in military service as well as education completed prior to service and to list formal in-service training courses successfully completed during this period of service; e.g. medical and dental, electronics, supply, administration, personnel, or heavy equipment operations in item 25. BOARD DISCUSSION: After reviewing the application, all supporting documents and the administrative notes below by the analyst of record, the Board concluded based upon the documentary evidence presented by the applicant and found within the service record, all requested relief had merit and should be corrected on the applicant’s DD Form 214. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by changing: * in item 24, add Marksman Marksmanship Badge M-14 * in Item 25, delete “2 WKS” and add “3 WKS” * in item 30, delete “11 Years” and add “12 Years” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. ADMINISTRATIVE NOTE(S): A review of the applicant’s records shows he was awarded or authorized an award not annotated on his DD Form 214. As a result, amend his DD Form 214 as follows: * item 24, add Marksman Marksmanship Badge M-14 * item 30, delete 11 Years and add 12 Years if Civilian Education REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 600-8-22 (Military Awards) states, the Overseas Service Ribbon is awarded to active members of the United States Army, Army National Guard and Army Reserve credited with a normal overseas tour completion after 1 August 1981. The ribbon may be awarded retroactively to those personnel who were credited with a normal overseas tour completion prior to 1 August 1981 provided they have an active Army status as defined above on or after 1 August 1981. 3. AR 635-5 (Personnel Separations – Separation Documents), in effect at the time, prescribes the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparing and distributing DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). It stated for: a. Item 22c (Foreign and/or Sea Service), enter the total amount of foreign service completed during the period covered in item 22a (1) (Net Active Service This Period). b. Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized), self-explanatory. c. Item 25 (Education and Training Completed) enter service schools, including major courses which ·were successfully completed, and military sponsored courses completed in civilian schools and colleges during period.
