Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents which are prepared for individuals upon release from active military service. It established standardized policy for preparation of the DD Form 214 and stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. The DD Form 214 provides a brief, clear-cut record of active Army service at the time of release from active duty. a. Paragraph 1-4 stated a DD Form 214 would be prepared for all personnel at the time of their retirement, discharge, or release from the Active Army. Personnel included are members of the Army National Guard of the United States and U.S. Army Reserve separated: * after completing 90 days or more of continuous active duty for training, full- time training duty, or active duty support * after completing initial active duty for training which resulted in the award of an MOS, even though the active duty was less than 90 days b. The specific instructions stated for: * blocks 4a (Grade, Rate, or Rank) and 4b (Pay Grade) – enter the active duty grade of rank and pay grade at the time of separation * block 12 (Record of Service) – self-explanatory * block 14 (Military Education) – list in-service training courses by title, number of weeks, and year successfully completed during this period of service 3. The Army's basic medical MOS was changed to 68W (Combat Medic Specialist) effective 1 October 2006. The Department of the Army Deputy Chief of Staff for Personnel issued a notice for future change for MOS 91B (Medical Specialist) in September 1999. The notice established the transition of personnel holding medical MOSs to begin 1 October 2001 and end 30 September 2007. FACTS: 1. The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states she believes her DD Form 214 is incorrect because her last unit, the 369th Combat Support Hospital, did not pay enough attention to detail. 3. She enlisted in the U.S. Army Reserve in the rank/grade private two/E-2 on 22 July 1998. 4. She was ordered to active duty for training effective 16 November 1998. She was released from active duty upon completion of basic combat and advanced individual training in three specialties on 24 February 2000. Her DD Form 214 shows in: * block 4a (Grade, Rate, or Rank), her rank as private first class * block 4b (Pay Grade), her pay grade as E-3 * block 12 (Record of Service), she completed – * 1 year, 3 months, and 9 days of active service during this period * no prior active service * 3 months and 24 days of prior inactive service * block 14 (Military Education), she completed the following courses – * Medical Specialist Course, 10 weeks, 1999 * Food Service Specialist Course, 8 weeks, February 2000 * Hospital Food Service Specialist Course, 7 weeks, February 2000 * block 23 (Type of Separation) – Release from Active Duty Training * block 25 (Separation Authority) – Military Entrance Processing Station Self- Terminating Order 139-8, dated 22 July 1998 5. Her records in the Integrated Web Service – Total Army Personnel Database Reserve show she was advanced to the rank of specialist, pay grade E-4, effective 13 April 2000. 6. She provided a letter from the National Personnel Records Center, dated 18 May 2017, informing her that a DD Form 214 is issued when a service member performs active duty or at least 90 or more consecutive days of active duty training. Her enclosed separation document would verify her initial period of active duty for training. Because her subsequent periods of active duty for training were less than 90 days, no additional separation documents were issued. 7. 65th Regional Support Command Order Number 002346, dated 21 February 2001, ordered her to active duty for annual training for a period of 20 days effective 27 February 2001. 8. She provided a Certificate of Participation for outstanding participation in Exercise Tradewinds 2001 from 17 April 2001 through 3 May 2001. 9. On 25 May 2001, she was awarded Certificate of Appreciation for outstanding service and assistance rendered to 1st Battalion, 20th Special Forces Group (Airborne). 10. 65th Regional Support Command Order Number 001123, dated 8 January 2002, ordered her to active duty for annual training for a period of 1 day effective 27 December 2001. 11. 65th Regional Support Command Order Number 002899, dated 20 March 2002, ordered her to active duty for annual training for a period of 17 days effective 14 April 2002. 12. She provided a Certificate of Achievement for outstanding support during Exercise Tradewinds 2002 from 1 April 2002 through 30 April 2002. 13. She provided a Certificate of Achievement for extraordinary achievement and performance of duties from 12 July 2003 through 15 July 2003. 14. 65th Regional Readiness Command Order 004572, dated 20 April 2005, ordered her unit to active duty for annual training for a period of 15 days effective 11 June 2005. The Annual Training Order Annex Report, dated 22 May 2005, lists her name as a unit member assigned to the advanced main body for a period of 18 days effective 8 June 2005. 15. Army Reserve Medical Command Order 022168, dated 7 June 2006, ordered her unit to active duty for annual training for a period of 14 days effective 10 June 2006. The Training Calendar Annex Report, dated 13 June 200,6 lists her name as a unit member. 16. On 25 July 2007, she was honorably discharged from the U.S. Army Reserve in the rank/grade of specialist/E-4. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, her record of service, the period of active duty shown on a DD Form 214, her subsequent Army Reserve service, the date of her promotion to SPC and her honorable discharge from the Army Reserve. The Board found no evidence of additional active duty service that would require issuance of a DD Form 214. The Board found the applicant was promoted to SPC after the period of active duty for training. Based on a preponderance of evidence, the Board determined that the rank reflected on the applicant’s DD form 214 was not in error or unjust. 2. After reviewing the application and all supporting documents, the Board found that relief was not warranted.
