The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, the bottom portion of her DD Form 214 for the period ending on 27 October 2001 is missing. She tried to obtain a copy from both the National Archives and Records Administration and from the Army Human Resources Command, but both agencies had same incomplete document that she currently possesses. 3. The applicant's DD Form 214 for the period ending on 27 October 2001 is not filed in the interactive Personnel Electronic Records Management System (iPERMS); however, she did provide a copy of this DD Form 214: a. The applicant's record contains an Army Commendation Medal Certificate (ARCOM), which shows the applicant was awarded the ARCOM for meritorious service, while assigned in support of Operation Joint Guardian, Task Force Falcon, Camp Bondsteel, Kosovo from 1 April 2001 to 2 October 2001. 5. The applicant's record contains a Noncommissioned Officer Evaluation Report (NCOER) for the rated period March 2001 through September 2001, during her deployment. Her evaluation for this period contained two successful block marks and three excellent block marks. Her rater marked her as "Among the Best" and her senior rater blocked her as 2-successful for overall performance, and as 1-Superior for overall potential for promotion. 6. Army Regulation 635-5 (Separation Documents) in effect at the time stated, do not issue a DD Form 214 to replace record copies or DD Forms 214 lost by the Soldier. If no DD Form 214 is available, issue a statement of service or transcript of military record. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was warranted. The applicant’s contentions were carefully considered. Her record is void of DD Form 214 copies that show the Special Additional Information (For use by authorized agencies only). The Board agreed it is the member’s responsibility to maintain copies of issued separation documents. However, the Board agreed to provide official documentation to make her record whole.
