ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS BOARD DATE: 4 August 2020 DOCKET NUMBER: AR20180002010 APPLICANT REQUESTS: in effect, payment of her Health Professions Officer (HPO) Specialty Incentive Pays (IP) under the new consolidated HPO-IP system for July 2017 through December 2017: * Board Certification Pay * Incentive Pay APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Leave and Earnings Statements (LES) from July 2017 through January 2018 FACTS: 1. The applicant states, she did not receive her incentive specialty pay from July 2017 through December 2017. During that period the system changed to a new consolidated HPO Incentive Pay (IP), but her LESs reflect the old pay system and do not include significant bonus pay for Army physicians. Most of her colleagues received the bonus in October 2017. She has since worked with her S1 and completed the HPO IP contract paperwork required, but a review is needed for her to receive back pay. Per her LESs she was not being paid under the new consolidated HPO IP system. Her pay needs to be corrected from July 2017 through December 2017. On 31 January 2018, her S1 submitted paperwork for correction of pay since January 2018. 2. The applicant’s available service records contain the following documents for the Board's consideration: a. A DA Form 71 (Oath of Office - Military Personnel), which shows she was appointed as Medical Corps officer in the Regular Army in the grade of Captain (CPT)/O-3, and she took the oath of office on 6 June 2011. b. A certificate showing the applicant completed training in Psychiatry Residency from 1 July 2012 to 30 June 2015. c. A certification which shows the applicant was certified in Psychiatry on 24 September 2015 and was current as of 30 January 2018. d. A letter from the American Board of Psychiatry and Neurology, dated 8 December 2015, which states the applicant passed her 2015 Psychiatry Certification examination held on 24 through 25 September 2015. e. A memorandum for the Surgeon General, Subject Request for Medical Additional Specialty Pay (MASP), which shows: * the applicant's on year continuous active duty was effective 1 July 2016 * she would receive MASP in a lump sum in the amount of $15,000 * she and the approving authority signed the form on 8 April 2016 f. A memorandum for the Surgeon General, Subject Request for HPO Board Certification Pay (BCP), which shows: * she was entering into the BCP agreement effective 1 January 2018 * it expired on 31 December 2025 * she would receive BCP at the rate of $6,000 per year paid on a monthly basis * she and the approving authority signed the form on 31 January 2018 g. A memorandum for the Surgeon General, Subject Request for HPO IP, which shows: * she was entering into the IP agreement effective 1 January 2018 * she would receive $43,000 a year paid on a prorated monthly basis * she and the approving authority signed the agreement on 31 January 2018 h. A license from the State of Hawaii Department of Commerce and Consumer Affairs showing she was a physician and her license expired on 31 January 2020. i. A DD Form 214 (Certificate of Release or Discharge from Active Duty), which shows she was discharged from the Army effective 30 June 2019 as a psychiatrist for general reasons. j. The applicant's service record is void of a memorandum for the Surgeon General requesting HPO BCP for July 2017 through December 2017. 3. The applicant provides her LESs from July 2017 through January 2018, which show: * in July 2017, she received BCP in the amount of $208.33 and Variable Special Pay (VSP) in the amount of $1000 * in August 2017, she received BCP in the amount of $208.33 and VSP in the amount of $1000 * in September 2017, she received BCP in the amount of $208.33 and VSP in the amount of $1000 * in October 2017, she received BCP in the amount of $208.33 and VSP in the amount of $1000 * in November 2017, she received BCP in the amount of $208.33 and VSP in the amount of $1000 * in December 2017, she received BCP in the amount of $208.33 and VSP in the amount of $1000 * in January 2018, she received BCP in the amount of $208.33 and VSP in the amount of $1000 4. BOARD DISCUSSION: The Board carefully considered the complete evidentiary record, including the applicant’s statement and supporting documents and found sufficient evidence to grant relief. The Board agreed that the applicant met all the criteria for award of Board Certification Pay (BCP) and Incentive Pay from July 2017 through December 2017. Therefore, the board determined that full relief was warranted. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: 1. showing that the applicant timely executed and submitted her BCP and IP request contract(s) effective 20170701 to 20171231, that her Personnel Office duly processed her request in a timely manner, and 2. paying her any BCP/IP due, subject to review by Office of the Surgeon General to determine period of eligibility and amount due. Title 37 U.S.C. 335 (Special Bonus Incentive Pay) states the Secretary of the Army may pay Health Professions Incentive Pay to an officer in a regular or reserve component of a uniformed service who is entitled to basic pay under section 204 of this title or compensation under section 206 of this title and is serving on active duty or in an active status in a designated health profession specialty or skill. Health Professions bonus paid may not exceed $100,000 for each 12-month period of obligated service. To receive a bonus under this section, an officer determined to be eligible for the bonus shall enter into a written agreement with the Secretary concerned that specifies, the amount of the bonus; the method of payment of the bonus under subsection (e)(2) (lump sum or installments); the period of obligated service; whether the service will be performed on active duty in an active status in or in a Reserve Component. 2. DoDI 7000.14-R (Financial Management Regulation) Volume 71, Chapter 5 (HPO Special and Incentive Pay) States: a. For BCP, the Health Professional Officer must: (1) Be serving in an Active Component (AC) or an RC of a Military Service and entitled to basic pay under Title 37, United States Code (U.S.C.), section 204 or compensation pursuant to 37 U.S.C. § 206 (2) Be serving on AD or in an active Reserve status in a designated health professional clinical specialty (3) Have a post-baccalaureate degree in a clinical specialty (a post Master's certificate acceptable to the Secretary concerned can satisfy this requirement) (4) Be certified by a professional board in a designated health profession clinical specialty. The annual amount payable is $6,000, to be prorated monthly. b. To be eligible for IP, an HPO must be: (1) Serving in an AC or RC of a Military Service and entitled to basic pay under 37 U.S.C. § 204 or compensation pursuant to 37 U.S.C. § 206 (2) Serving on AD or in an active Reserve status in a designated health professional specialty. c.
