The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states her SSN is XXX-XX-XXXX, not XXX-XX-XXXX. She does not know if it this was an error on her part at the time of enlistment or a clerical error when her data was entered. She did not realize her SSN was incorrect until her father passed and she found her records while cleaning out his home. She contacted USAA insurance for a quote and needs her discharge papers with the correct SSN. 3. A review of the service records shows the following on: * 19 May 1981 – enlisted in the US Army Reserve (USAR), she reviewed and signed a DD Form 4 (Enlistment/ Reenlistment Document) that day which shows her SSN listed on each page as XXX-XX-XXXX * 2 February 1982 – honorably released from active duty for training and transferred to the USAR, a DD Form 214 issued shows in item 3 (SSN) her SSN is listed ending in XXXX * 20 December 1985 – transferred to the USAR Control Group (Annual Training) by reason of Unsatisfactory Participant for accumulating 9 or more unexcused absence in a one-year period 4. The applicant provides: * enlistment contract dated 19 May 1981 which shows she enlisted in the USAR with the SSN ending in XXXX * DD Form 214 for period ending 2 February 1982 which honorably released her from active duty for training and transferred her to the USAR after completion of 4 months and 11 days of net active service for initial entry training * Orders Number D-05-C3418C issued by the USAR Personnel Center wherein the applicant with the SSN XXX-XX-XXXX was honorably discharged from the USAR Control Group (Annual Training) effective 18 May 1987 * Certificate of Honorable Discharge issued on 18 May 1987 which shows her maiden name B_J_P and her SSN ending in XXXX * Social Security card with the name B_J_B which shows her SSN as XXX-XX- XXXX * Marriage Certificate issued on 15 November 1986 that shows her name as B_J_B upon marriage * letter from National Personnel Records Center directing her to the Board for correction to her military records 5. Her military service records is void of any evidence she used the SSN XXX-XX- XXXX at any time during her service, and any documents listed with that SSN were crossed out and replaced with XXXX and initialed by the applicant. 6. Army Regulation 635-5 (Separations Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. Item 3 states to transcribe SSN at the time of his separation from applicable documents. All documents completed and signed by the applicant had her SSN ending in XXXX, and any that had XXXX were changed back to XXXX. 7. Army Regulation 635-8 (Separation Processing and Documents) states, in effect, that the administrative entries are provided by the Soldier. It further states, for block 3 (SSN), verify accuracy by reviewing initial enlistment contract and/or application for appointment. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board discussed the applicant’s statement and supporting documents to include her Social Security card issued in 2017. The Board also noted a correction to her SSN with initials making it the SSN consistent with the one in her records. The Board determined that the preponderance of evidence did not support a correction to the applicant’s record. The Board noted that a copy of this decision would be placed in her records to clarify the difference in SSNs. 2. After reviewing the application and all supporting documents, the Board found that relief was not warranted. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. Item 3 states to transcribe SSN at the time of his separation from applicable documents. 3. AR 635-8 (Separation Processing and Documents) states, in effect, that the administrative entries are provided by the Soldier. It further states, for block 3 (SSN), verify accuracy by reviewing initial enlistment contract and/or application for appointment. If the Soldier has had more than one social security number, list the other social security number of record in block 18 (Remarks).
